tiptronic shifting problem..recurrs again after fix
after one week in the dealership, my wife cayenne was returned with a new tip shifting module to fix a faulty auto tranny that wouldnt shift on occassion...it appeared to be fixed with smooth and timely shifts..but it rained tonight, and it did it again, getting stuck in first, the third then it was ok...the problem seem to occur in the rain in the past also...so its back to the dealership again...this sucks...it is dangerous in traffic when this does this...what if they cant fix it...do we have any recourse.....any ideas ..thanks

Your recourses are as follows:
0. Speak with the GM of your dealership and ask what he can do to permanently rectify the problem (buy the car back with the proceeds going towards a comparable replacement Cayenne, which will hopefully not have the same issue) or act as an intermediary between yourself and the PCNA regional/district service manager and/or field engineering manager.
1. As outlined in your warranty book, please refer to the rules governing the invocation of arbitration in your state. You will see a number for the arbitration board which PCNA uses, along with contact info and details.
2. Refer to the laws in your state regarding the return of a vehicle under a 'lemon law'. Please pay careful attention to the EXACT wording that the service advisor enters into the PCNA service computer database and the EXACT number of times/dates that the vehicle has been brought back to the dealer for the EXACT same problem. Be sure that the vehicle has been returned for the EXACT same problem using the EXACT same wording...yes, it does matter.
3. Consult with a local attorney and file suit in your local district court. PAG, thru it's US agent PCNA, is required to maintain an 'office' in each state in which is sells cars. This is normally handled thru a transfer corporation office in each state....an attorney can guide you thru this. Ask what the maximum limit you can sue for in district court. By going to district court in your state/county, you will force PCNA to hire local counsel and travel to your jurisdiction to litigate your case. Your cost to bring suit against PAG and PCNA will be somewhere in the area of $300. Once PCNA is served, they are forced to represent themselves in the lawsuit.
Don't ask how/why I know, trust me, you don't want to know.

From what I hear, PCNA central system does not contain records of all reported problems (explains a lot) It only contains the warranty claims wording, not the trouble report. The only place that is held is at the dealer. Systems vary by dealer, mostly DOS and UNIX legacy systems with little reporting capability, not connected to Atlanta. So...as lemon law goes for the manufacturer...that would be the best route.
