Does anyone know if the 2008 RS's will be equipped with PSM (PMS) as per the new Federal legislation or does traction control cover the stability management issue.

Not required until 2011-2012:
Compliance Date: Consistent with the phasein commencing September 1, 2008, all new light vehicles must be equipped with an ESC system that meets the requirements of the standard by September 1, 2011, with the following exceptions. Vehicle manufacturers need not meet the standard’s requirements for control and display requirements for the ESC malfunction indicator telltale and “ESC Off” switch and telltale (if provided) until September 1, 2011 (i.e., at the end of the phasein), and vehicles produced by finalstage manufacturers and alterers must be equipped with a compliant ESC system (including the control and display requirements) by September 1, 2012.

As you can see on page 217 (top) of the previous pdf document, PCNA has send a letter to NHTSA stating that ALL Porsche cars will be equiped with ESC (Electronic stability control) by september 1, 2008.
This means that: a) GT3/RS will include PSM on MY09 or b) No more GT3/RS at all...

Agree with MJones. So the real question is when GT3/RS will be available again after jan 08... and if PSM is the sole change introduced.

That's how I read it.
A revised 997GT3 for 2009 and 2010, overlapping with the 998 introduction in 2010 (just as the 996GT3 overlapped with the 997 introduction in 2005), would follow the current pattern. In addition to PSM and the new sport seats introduced on the GT2, we could see a DSG/PDK gearbox, direct injection and/or 3.8 motor, LED lighting to match the forthcoming facelifted 997...
It will be an improved car. There is a lot of competition coming out in the next couple years.

From Page 18 of the standard document:
While I'm certain this mandate will present headaches for race teams who want to "rip the system out" of cars run as dedicated racers, I'm not as worried as before that the electronic nannies would shut down all our fun.
At 327 pages though...I ain't getting through this whole .pdf doc any time soon.
In certain circumstances, drivers may have legitimate reasons to disengage the ESC system or limit its ability to intervene, such as when the vehicle is stuck in sand/gravel, is being used while equipped with snow chains, or is being run on a track for maximum performance. Accordingly, under this final rule, vehicle manufacturers may include a driver selectable switch that places the ESC system in a mode in which it does not satisfy the performance requirements of the standard (e.g., “sport” mode or fulloff mode).
