Need to vent
A tree on my property fell on my neighbor's house and my homeowners insurance paid 100% of the damages. The fact that my chain saw was imbedded in the big end might have influenced the decision.
Its her tree so her insurance is to pay for the damage. Also the property owner is responsible for removing dead trees to prevent accidents like this. Thats the law where I live.
Call your city hall and ask them what your local laws/rules are.

You pay good money for auto insurance. I recommend you call your auto insurance company and file your claim with them. Offer to provide them all of the pictures that you may have taken. They will know the prevailing laws and if necessary they will contact the homeowner's insurance company if required. If they are successful in collecting from them, then your deductible will be refunded back to you. Don't forget to ask your insurance company about diminished value. This will help keep you at arms length from the process and any existing goodwill between you and your neighbor will be preserved. "I'm letting the insurance company take care of everything", is a good place to be. Good luck!
Just a thought, could filing an auto insurance claim raise your auto rates? Not sure how that would work in your state.
I would probably reach out to the HO insurance first... they should have a good understanding of your states laws as to where the liability falls.

Yes well, if I had a garage that was big enough I'd probably do that as well.
Went to a body shop yesterday. He figures around $5k. OUCH. We'll be pretty much repainting the right side and front of the car. Windshield may have to be replaced because the rubber seal is damaged. Dented the A pillar too. Filed a claim yesterday.
I'm not really too worried about diminished value. The car has 51k miles on it and I intend on adding lots more, so the diminished value should diminish over time.

Well, it holds motorcycles. But apart from that, it's very narrow. If I have a car in it I can barely open the door. Something that I found out after I bought the house. Yes, I could use it to store the car for the winter, but if I actually want to use it, it's completely impractical.

Came home to find part of my neighbor's tree had landed on the car. Took out the RHS mirror and dented 3 body panels. The part that's truly annoying is that she has a bunch of dead and dying trees leaning towards my driveway, so this was only a matter of time. Hopefully now she'll finally take care of it. Crap. Did not need that. Hate living in the forest.

I am no lawyer but owned and insurance agency a few years ago, and in AR there has to be documented proof that the trees (dead ones) were reported to the home owner and they failed to trim them in a timely fashion prior to any related accident. Sometimes people dont even know they are dead, not every one looks to the sky. As far as own property own insurance. I think this is to prevent your own homeowners policy from refusing to pay for damage to your home if the branch, cow or mobile home that fell on your house during the last big storm was not yours. AR laws that is.
