if they have less than 50% of tread left - yes, if not - not sure, it is difficult to see how deep this scuff is. it is pretty close to the rim, changes of it to contact with anything are slim imho.

Take a good clear picture & measure the dimensions (length, width & depth) & send it to the technical department @ Michelin ( http://www.michelinman.com/contact/ ). If they don't give you a clear answer (which is rare) ding them on the satisfaction survey & you will get a call from them & you can discuss it further. Only Michelin knows what beneath that hole & the safety that may be compromised.

If you have tire insurance why bother to ask us here? Besides, I already know what the tire insurance guys are going to tell you. Your tread depth is too low--you have no warranty remaining.
