In the interest of accuracy, my dealer yesterday backed away from doing a CPO. They thought it over and simply stated that they do not want to accept any liability in the transaction and that they can not get a legal waiver (in their opinion) no matter what the buyer offers to sign. They also told me that it does not matter if the car is purchased out of state; their state law (in this case New Jersey) protects buyers in all 50 states.

However, I know that some dealers will do a "courtesy" CPO; obviously the policy varies from one dealer to another. A potential buyer can ask their local Porsche store if they are willing to do this for them.

I have been told a dealer must own the car to have it certified...is this not true?

yes.
usually you and seller agree price of car, and price of CPO. seller sells car to dealer at $X, they do CPO, then sell the car to you at X+CPO cost.

U know my friend with his EVO keep showing issues everytime he's on track Mooty : ). He's coming up Sat nov 10-hope his evo doesn't have another hiccup. Mike
