This is why our judicial system is so screwed up. Because the people that "do" and by "do" I mean proven, actually commit the offense are allowed to blame that on someone else and get off. Not throwing any stones at the OP's wife here just playing devils advocate. Just because everyone else is doing it doesn't mean it isn't breaking the law.
