RECOVERING DIMINISHED VALUE AFTER A ACCIDENT
Franklin county court of common pleas awarded diminished value to a car owner in addition to the cost of repair.
Rakich v. anthem Blue Cross & Blue Shield
172 Ohio App.3d 523, 2007-Ohio-3739
You may not recover damages in excess of the difference between the market value of the car right before and right after the accident.
Scott E. Smith of Smith Phillips & Assoc won the case.
