Some of the E46 M3s use a flexible boot lip blended into the boot lid. So all you need is an appropriate lip. I already have a spare spoiler on my car that I had the grill painted body colour on for a more up to date look; Could be a nice upgrade.

This is where I am at. Just need to adjust it so it sits a little up, maybe an inch up from the back.

Flexible rubber, bondo to make it smooth and painted matt black.

It looks like the bottom part of the spoiler is open?.......does it sit flush..........
