Default Non refundable Partial payment toward Vehicle.

Got a call today about a Carrera S allocation. They want a Deposit that says it will be non-refundable and partial payment to the car. I really don't mind this going towards the car. However, the salesman told me the deposit was refundable and the document clearly states it will not be.
Anyone have any experience with this issue?

Depends, are you doing a yellow and Bordeaux interior? If yes, then that’s normal.

Depends on the state whether this is enforceable. It's explicitly outlawed in 11 states.

I Would be ok with it as long as the final sale price is clearly stated, and that they clearly state that no additional services or financing are required.

Deposit is fine, partial payment is not the norm.

Side note: my local dealer called me last week and offered an S allocation after telling me i was number 17 or some **** this last summer!?? I have a T arriving any day, so it’s a little bittersweet.

In Texas, partial payments towards the price of the car are non-refundable.

"Deposits" (which is different than a partial payment in TX) is arguably also non-refundable, but the law is not clearly settled on this particular point.

Im also from the DFW area and that sounds like something the Plano dealer would do. They are sneaky like that. Its the worst dealership of all the DFW area.

It is indeed the Plano Dealership. I have to tell you it feels like something is not right. I have been on a list since June in Austin, San Antonio and Houston. I sent them my build yesterday and now I have an allocation? But, SA says that the 5000 is refundable and the paperwork they sent me to sign clearly states Partial payment and non-refundable.

i'll pop by the various porsche dealers in dfw for something to do when visiting family. can confirm, plano dealer is sketch. go with you gut and get the deal cleary in writing. if you're in a position of 100% certainty you'll follow through with the deal then just hold your nose and swallow.

a dealer near me had an S allocation up for grabs back in october. so it's not unheard of these days to get one quickly.

When I ordered I was told my deposit was non-refundable. I balked at the idea, but then thought about the fact that I was ordering to spec and I knew I would not back out. So it was fine. I did ensure all the terms, MSRP less discount, etc. were in the agreement. I even negotiated a better discount at purchase. However, this is the sticking point, give them the $5k and sign the contract, but ensure they can't add ADM unless you already know and it is defined, and they can't add other items. Make sure all the terms of your purchase are included along with the non-refundable. They can protect them but you gotta protect you too.
