It is seated as much as possible, there is a gap that is filled by a piece of foam that comes on the end of intake. Is this designed to be seated with a gap like this? Reason i am asking is the car was in a rear end collision when it was new. 2012 Carrera S
I really wouldn't worry about that. It looks materially sealed to me. Even if there is a small amount of warmer air being pulled in, it is not impactful to performance.
The duct is designed to draw cool(er) air from above the engine lid, so duct leaks in that area might allow some hotter, engine compartment air to be drawn in, but I doubt that it makes much difference. It mixes and all gets filtered and measured before going into the engine.
This bothers me on my car as well. It’s like that piece of ductwork is warped or it just never fit right in the first place. The foam is pretty much all gone on my car.
It's not seated correctly - when putting it in you need to put the top into the ducts from the upper edge before pushing it down on the grommets. Line up the top ridge and then push down, that should do the trick.
Same gap on mine, I currently have the rear bumper cover and whale tale off the car so I could see into the engine compartment when the lid is closed . When you close the rear lid it applies pressure to the air intake and I can see the intake compresses the foam closing the gap

I think you're right on that point... when the cover closes, it *does* smush it all down a bit. Still -- doesn't feel very German precise in the way it goes together.
