i've had 3 totaled cars (none my fault) and every time they offered way more than i expected and i came out on top. i wouldn't worry too much until you get an actual offer. as long as you have a good insurance company you should be fine.

I am in CA and I have been an attorney for over 20 years.
When I started working, it was for an insurance defense firm. That work really sucked.
The money is in personal injury.
There is no wiggle room in car property damages. They use Kelley Blue book and that's it.
I do not know any attorneys who would handle a property only case.
So sorry. This totally sucks.
If I were in that situation, I would have the car repaired but find someone to do the job for less than the quote.
Then I would try to sell it. Someone would eventually buy it.
But, as noted previously, the economy is bad.

I have a friend that was in a similar situation with a 911SC and he hired an appraiser from Hagerty to assess the vehicles value as the insurance company could not come up with a value.
On a more positive note, your insurance CO is going to subrogate the loss against the insurance policy of the responsible party.
In the end a 110 day old bill of sale may be appropriate to determine the value of a one-off vehicle.
Your last ditch effort will be to file a claim for however much you have lost (what the insurance companies do not cover) in either small claims which is $10K in NC. Claims above $10K to $25K are handled in district court.

That SUV had to be really going fast to punt a parked +3,300 pound car over a high curb, that was in 'park'.

Here is another thought, is the offending motorist underinsured? (in which case I hope you have underinsured coverage, you likely do given you are driving a high dollar car) In that case it means now both the offending carrier and your carrier are on the hook and they are seeing what they can pull?

That suit your purpose and forward them to the adjuster. they need paper to justify their decision. They are not going to do any work to help you. That being said' Im buying an agreed value policy this week due to you post. I was on the fence but this made my decision.

I personally would not draw premature conclusions. Just because the adjuster is saying things you dont like doesnt mean its final. Let them do their work and see what they come out with. If its in the 1-5K range off, I wouldnt hire an attorney. I would look and find other similar cars and give them the info, they will adjust and rule in your favor.
If its 10k+ off then I would ask them to provide you with documentation of how they came to that conclusion first.

Kelly Blue book is used by Car Gurus and Autotrader which under value all cars, it's a game they play just to make money on all sides. The best in real value is Nada which used by all dealers and banks. Before the Internet they had 2 books, 1 in blue and the other in black. Your insurance should pay you more than what Nada value shows.

Desmotesta, start getting comps now. Don't ignore the great comps you'll find in "The Mart" at the back pages of Panorama magazine.

If all else fails, what you might want to try is tell the ins. Company you installed expensive aftermarket parts. I had a 350z that was totaled years ago. The insurance company lowballed me. I told the rep I had parts on the car, they cut a check for the higher kbb value to compensate.
