Loss of Use for 2013 Carrera S
Hi Guys,
You might have seen my car accident thread earlier, where my 2013 C2S was rear-ended and unfortunately was a total loss. While my bodily injury claim is ongoing, I'm starting to do research for the loss of use which I'm eligible to claim in California. It has been difficult to determine a 'reasonable' claim since a 911 isn't exactly a Hyundai rental from Enterprise.
What do you think would be a reasonable claim for loss of use? I was without the car for 61 days, from the accident on 12/21 to my total loss settlement on 2/20/2018. Simple research from Hertz Exotic/Gotham Dreamcars/Prestige Rentals etc shows $500/day for a 911 C2/C2S rental. Obviously that would be negotiated down considerably for monthly rate/my car being older and so on. I don't think there's a chance in hell that i'd get anywhere near that.. but where should my baseline be? $2000? $5000? $10,000? I did not rent a car during this period, so there are no receipts to be reimbursed. California law suggests that I be given payment for a similar vehicle's rental during the time I was not allowed usage of my vehicle. The vehicle was a daily driver.
I appreciate any thoughts for this!
Cheers

I tried this over two years ago, with receipts, haven't seen a penny yet.

Yes except at face value the 'rental' of a 911 for 2 months could be $10-30k depending how crazy you wanna get. I don't think any company is going to contemplate paying that.
I wouldn't mind going to small claims or hiring an attorney. Their client's negligence massively inconvenienced me, and I'll get my money.

Better luck pulling 8k from a chiro/lawyer team with a letter how much your neck hurts. That comes directly from a claims agent. Throw in the usage thing oon straight 40% contiingency. You may end up whole.

I'm in the same boat. Was T-boned 2 years ago in my 911 when a lady ran a red light. I hired an attorney and am going to court next month. I am seeking both loss of use at 450-500/day (4 1/2 months of repair time) and diminished value of approximately 15K. I hired someone to calculated the diminished value on the car which I immediately traded after it was fixed for a new 911. I'll let you know how it goes!

Yep. Exactly what I was thinking. A good attorney will make you whole...
