Need advice about poor vendor
Hi Guys, I am after some advice into a transaction that I made through a vendor who is now banned on Reenlist.
In Oct 2016 I put a 50% deposit down for goods with a 12 -14 week lead time. When that time was up I was informed that there was a newer and better system in the pipeline and would I be prepared to wait a little longer.
After a long wait and not always getting a response to phone or email I was informed in April of this year that a system for my car was becoming available. After trying to touch base during the last week the business phone is not in service and I am not getting replies to emails.
As I am in Australia and the business I refer to is in California my question is what rights do consumers from overseas have in regards to US businesses and any suggestions of where to go now? The whole exercise has been disappointing and frustrating, I only went forward with the order after a couple of positive suggestions from Reenlist members back in 2016.

Guess it depends what the 50% is worth.

The next step is to send a demand letter. “You owe me this much money for this reason, you have 30 days to make it right or I will pursue legal action.” Send it by email and by post - send it “certified mail” with return receipt if possible where you are located. If no response you’ll have to get someone to sue them (presumably) in small claims court. It may or may not be worth the headache. May I ask how much money is involved? Good luck.

If you put the deposit on a credit card, that may be the easiest way to get some $$ back. Contest the charge as undelivered. I had a relatively recent experience with a wine maker in France that did not deliver wines sold and Bank of America Visa took care of it almost 3 years later after some pushing.

Total you were to pay was $24K USD and you are out $12K USD? Is company still in business? You may seek restitution from the Credit Card company, always worth a try, but there are often time limitations for recourse. If company still operating you are likely going to need a lawyer local to you who has some US connection and pursue your claim. Good luck, the more documentation you have the easier it will be to pursue legally.

Ouch - $12,000 is the 50% deposit? Ok, that will exclude the claim from small claims court you’ll need a lawyer and will have to pay some legal bills. The poster above me is dead on - if you put it on a credit card disputing with the credit card company is your best solution. If not and you decide to sue understand that even if you win in court collecting the money from the vendor could be difficult or impossible if he’s broke or filed bankruptcy. This is general advice I am not a CA lawyer. Keep us updated please.

I believe the US angle was just a distributor.
As far as I'm aware they don't do anything for 991 GT3/GT3RS/GT2RS
