Thanks again guys, to answer one of the questions above, we were pushed/thrown forward about 10-15 feet, really glad we didn't hit another car in the front or even the cross-walkers....
I can't imagine if we hadn't been there, there is a good chance the CHP would have hit the folks on the cross-walk!

Terrible story! Unfortunately it was the cop that hit you. Of course it is their word against yours and theirs will always hold up. I sincerely hope they take full responsibility for the accident and don't pull any of that "he slammed on the brakes." I've never heard a positive outcome from an accident with a cop. Again, it's probably best to lawyer up. Here's to a speedy recovery
Anyway, in Crescent City, I stopped at cross walk for 2 folks to cross. And then the CHP officer hit us at 35mph. It pushed the car forward about 10-15 feet.
The officer said that she stopped looking at the road to observe oncoming drivers using their cell phones.
Oh the irony!
Seriously, it seems CHP needs to re-evaluate their strategy on enforcing highway safety and the instructions they give their patrollers.
That is just the stupidest thing ever!

- Property repair has been agreed upon, its about $20k in repairs, my insurance covered all this
- Their insurance has agreed to a rental for a few months (probably 3) while repairs happen, reimbursement for my deductible and towing
- Their insurance is going to cover our health costs, but still needs to be worked out how much. My son just cleared his concussion process but is still taking it easy.
- Only remaining open issue is the diminished value of the car. I need an expert to write up a letter on the diminished value aspect. Anyone have any ideas on that? PM me please

I know the state is doing bad....but C'mon.....
If they are 100% at fault then they have 100% of the responsibility.
If your insurance covers any part on this, then most likely it will be passed back on to you somehow.
I really hope you consulted a legal expert...

If this a California law or something? Or is your insurance company suing their insurance for reimbursement of the costs of repair?
It's called "subrogation". The insured is made whole or nearly so, meanwhile the insurance company goes after the person at fault (who probably is insured also).
