Well... it seems that I go out of town and I get nothing but trashed.

Interesting, how some people implied that I was:

1) Hiding
2) Broke or having financial problems (ie selling one of my cars)
3) Avoiding this list (or any other list for that matter)
4) Not taking Ian's calls.
5) Am a Webmaster
6) Own ArchWebDesign

Well everyone can rest assured that:

1) I don't hide from anyone.
2) My finances are my business. And... I can assure you all that the money, $275, that was refunded to Ian (or according to Ian... supposed to be refunded) represents less than 2 hours of my billable time... Hardly enough to make me want to steal (as some of you have implyed or stated outright)
3) Why would I be avoiding this list or any others for that matter? Becuase of an issue over $275? Sad but funny....
4) I've always taken Ian's calls. I've not received a message from Ian for quite a while now (several weeks). If he's called... he's not left a message. And I can guarantee you that he has not, or does not call me every day. That's a lie.
5) Email: I now receive about 500 emails per day. I have serveral spam filters in place. When I leave for a day or two, the email sitting in my inbox is enourmous. Yes... very often, I delete an email. My email filters produce a false positive. Or an email gets routed through or systems where I don't get it. I belong to not only this list, but several others, some of which don't concern Porsches (or cars for that matter).
6) Webmaster: I'm not a webmaster. Creating a site for a couple of my friends doesn't make me a webmaster. In fact, I wish I never had because it's nothing but a lifetime warrantee of free work and upgrades!
7) We stopped building web sites about 2.5 - 3 years ago. I got tired of people calling us out of the yellow pages, "How much for a web site?"......

Every part that I've sold, has been sent and received except Ian's (according to Ian).

The only other problem I had was with a set of injectors and manuals that were sold. The package came back to me several weeks later opened up (in fact, the stuff came back to me in several boxes). To accomodate Mark, I sent him, overnight, a second set of RC Engineering injectors. I also told Mark, that I was missing the cover for one of the manuals. Don't ask me why... I have no idea. Then, out of the blue, another package was sitting at my doorstep with an empty manual cover in it about a week or so later. I advised Mark of this. I also told Mark that I was going to wait and see if I could bet the entire set together. I told Mark that if I couldn't that I would refund his money. Well guess what?.. I got the entire set together as promised and had them sent off.

I've probably sold over 100 parts (no I don't keep count.. but it's been a lot of parts) to listmembers over the years without so much as ONE complaint until now.

No complaints over delivery, quality of the parts (usually they are much better than I describe them), or any other issue.

For the record... I've been out of town opening up a new office as well as looking for a second new office to open up. So yes I've been busy... and no I've not been here sitting on the list all day hiding.

It's amazing how people that don't know really anything about me, can sit there and pass judgement, magically see my finances, know my business, etc...

Ian... you've done a pretty good job at slandering my name etc... I hope you're happy. And, becuase of your untrue claims and because of your slanderours actions, I don't intend to spend 2 seconds tracking your package, looking to see if your check has cleared, or dealing with you in any way shape or form, etc... Maybe next time you will think before you act.

Because I'm not around doesn't give you the right to do what you have been doing.

This whole Porsche thing is getting (has gotten) to be more trouble that it's worth.... it's gotten real old.....

That all said, this will be my one and final post concerning this subject matter.

Ian sent you the money and held up his end of being a customer, but you did not send the product. Now... since he asked questions, you feel he slandered you. I am an impartial party here, but from your response, I read you are tucking tail and running.

Be a man, an enthusiast you used to be, and send the man his money. It is not yours to keep, for your precious time, or for the lack of product you sent.

No one cares about your situations of opening a business except Ian. If this was to be an issue, you should have relayed it to him. It does not sound like you did anything to finish the deal.

Here's a guy admitting he took money from another member, admitting he doesn't need it, and for some incomprehensible reason refusing to refund or provide the parts purchased. Tony's rant is well justified to some other people, but not to Ian. Ian even stated a few times how he didnt want to invade on Tony, like calling his friends (huntley) ect.. Unless tony can prove he sent a check or package to Ian then he is nowhere. Even on ebay if a buyer says they didnt recieve something, the seller says they did, they seller is wrong until a tracking number is submitted.

Tony may have recently come across these posts and sent the money/package and act like he did a long time ago. He states nowhere in his post when it was shipped, but carefully words things in his favor.

See Ians post above which was before you ever chimed in which shows Ians honest intentions, even defending you and hoping that you are well. After Tony G's response, you can see what ******** are in the Porsche community. We all make mistakes but we do have to rectify them. I still remember all his bull**** flame mail a year or two ago. Looks like he is a typical Los Angeleno anus.

Pay Ian and apologize to him as well. Perhaps you are helping Gray Davis and his Oracle buddies give it to the rest of California you know where.

imo a better reply (something along the lines of): "there seems to be a big misunderstanding.....was away on business....i'm offended how conclusions/opinions have be made about me w/o hearing my side of the story....i will do whatever is in MY power to put this subject to rest......I'm SORRY". when confronted, someone goes directly on the defensive imo its an admission of guilt. imo being stubborn by saying your not going to track the package etc.... is only going to solidify people neg. opinions.

i inserted imos because they are just opinions and dont mean jack...to anyone but their author

O-how do I respond, i'm not even sure I can come up with anything to equal the audacity of your post, I can not believe you are trying to make me look like the bad guy and can justify not paying someone back like you did.

But a few points
1) I did call many times
2) I did email many times, and you say you get so many emails so you can't respond to them, then how is it that you responded to them when we were working on the terms of the sale?
3) I did not slander you, in a law class I took it was explained to me that the best defence for slander is the truth, and now you have given me even more to work with on that front.
4) I did not, again, I did not recieve anything from you, i'm sorry that the dollar amount in question is not enough for you to worry about, well it is to me.

So again, I ask for a very simple thing, send me what is mine, you did not earn it, just as you did not earn anyones respect with your last post....

Ian made every effort to resolve this off-line. you made it impossible.

An now for some legal tech...since there has been deminimus porsche tech in this thread.

Your assertion that you have been slandered is completely ricockulous.

For the uninitiated:

Ricockulous; adj: late 20th C; mumzerian english slang: of or pertaining to something so ridiculous that the dick has actually turned into a ****.

But i digress;

I say that the allegation of slander is ricockulous becuase slander is oral, libel is written. I should add that the ability to prove the accuracy of any statement is an absolute defense against any claim of either slander (which can not have occured) or libel.

I'll spare you the legal definition and the fancy law school syntax (since they might force you to invoke your super extra gnarly guy billing rate), and sum up as follows (although i cant resist pointing out that a porsche content and community site is likely to be frequented with folks who's billing rate is somewhat more impressive)

Ian aseerted only that he had paid you for pats that you have stil not delivered. He has been asking for his money back in a public way on a forum you are known to use.

You have subsequently confirmed that you have still not delivered his parts or his money.

Now under the weight of public pressure you are refusing to bow to the internet community. Are you getting your material from Iraqi TV?

Just refund his money and lay off the variety of shaggy dog arguments about why it is ok.

You have not asserted that you did return his money or deliver his parts. You have just publicly asserted that he was telling the truth. You have made his slander (well..libel actually) defense for him.

Get your legal tech straight before you open your mouth and give the guy his money back.

Ian has behaved like a gentleman.
