Default Stupid people...



Sigh, became another one of the 'rear-end statistics' today.
Sitting at a red light, look up to see some guy flying at me from behind. Have just enough time to close my eyes before he hits. Back is smashed, both sides are warped at the flares making it hard to open/close doors, front's a bit bashed from where i hit the car in front. damnit.

just venting


any suggestions for the insurance process? i've already filed a claim with his and my insurance.

Be glad that he has insurance, California is the land of the uninsured. As Eyal said and by your description of the damage most likely a total loss. I would let the insurance declare it a total loss, than get the money and buy the car back from them for a little, than you can fix it or part it. Btw what color is your interior?

I have been hit by at leats by 3 ppl who didn't have insurance here in Southern Cal., back in 1993 a hispanic lady driving a piece of junk car rear ended my 1993 XLT Explorer and it was a total loss. She gave me some bogus insurance ID card and she had no driver license, to make it short my insurance co. paid off the car but I loss my down payment. Just don't give so easy on the insurance offerts play hard to get. Ohh yea I like your wheels too!!

I had a 16 year old smash into the back of my BMW about two weeks ago. Stop and go traffic on highway. Just got it back from the shop and it looks good. If they want to give you a low number, tell them you want your mods back or that you want to be reimbursed for the cost of them separately.

Argh!!!! So sorry to hear that..... I had to dodge a nut the other day and although I missed him, I ended up bending the rocker panel in some on the side. Not bad, but it's a pain in the butt to have to deal with.

sigh... latest update...
He's got an At Risk policy which basically means that he's a terrible driver but the state requires the insurance compnanies to provide him with the minimum insurance (but he pays premiums out the ***). Anyways that means he has 5k worth of property damage coverage - which is definitely not going to be enough. Damnit I hate idiot drivers!!!!!!!!!!!!!!!!!!!! Looks like I'll be needing a lawyer...

Hope you declared your modifications to your insurance company, or at leat swop them back before they inspect the vehicle. If you have not decalred the mods you may find your insurance company have a way out of paying out too. Here in UK there are loads of ways insurance companies get out of paying, e.g non factory alloys, non ZR rated tyres (I heard of somebody who had a 951 on VR rated tyres and the insurance company refused to pay) Non Stock Tail pipes etc etc. And on the basis we pick up a lot of our business law from the US it is most likely the case over there too.

Man that sucks to hear. My dad got rear ended the other day commuting to work, and also got shoved into the guy in front of him. Guy that rear ended him of course didnt have any insurance. The guy that rear ended him didnt like hearing my dad say "yea, well my oldest son is a lawyer, and my other son is a chiropractor." I am sure that ruined his day...lol.
