Absolutely true.
It used to be that the benefit of the doubt went to the seller. Now it almost seems as though the pendulum has swung too far in the other direction to protect the buyer - even allow for buyers to easily scam sellers.
A buyer can now file a complaint that the item was received damaged and the seller only has two options:
  • Provide a full refund to the buyer with the buyer keeping the item, or
  • Provide a full refund to the buyer once the item has been returned to the seller.
Nothing requires the buyer to prove anything.
I suppose too many sellers were scamming buyers...

I have never had an issue with a PayPal dispute where I didn't get my money back and I've had to do 3 or 4 of them over the past 10 years or so. As others have stated, it's sometimes important that you can prove you sent the item back to the seller with p OOF of tracking after delivery or a proof of delivery, like with UPS.

I have quite a few CDR30 factory Porsche radios for sale and I had to stop selling them on eBay. After the first scammer bought one and destroyed it trying to pry off the buttons he filed a claim that it was not as described and damaged. The box was in pristine condition and the buttons were not crushed but pried outward as if he used a large metal screw driver. After that I started taking HD videos of each unit before I boxed it up and shipped it out. I made sure to capture the serial numbers, the factory "do not break this seal or the warranty is void" labels, and I shook it to show that it had no internal rattles (the first scammer sent me a video saying it rattled). The next scammer said that the unit was defective. He had fried it on his test bench and then sent me pictures of the warranty labels cut claiming that someone had previously tampered with the unit before he got it. Luckily for me I had the HD video showing the unit intact. He filed a claim, eBay pulled the money out of my account, and when I got it back from him it smelled like an electrical fire. Without that video I would have been out all the money but I shared it with eBay and they actually sided with me and put the money back in my account. I won but he nailed me with negative feedback- the only one I ever received until I sold a guy a can of Bondo that was sitting in my shop for a year or two that he claimed was "...kinda of old". What the hell does that even mean anyway? eBay is definitely a love-hate relationship...

WOW! The latest is this guy has now asked ebay for help???! He claims he micro engraved the lens before sending it to me "because of people like me". When I sent him pictures of the cracks after receiving it packaged too tightly, he didnt see his micro engraving, thereby proving that I switched the lens but offered me a refund anyway and still later has decided not to refund me after receiving the item back. I advised him that he has some "friends" on a certain forum (un-named of course) that have suffered from his item quality, service, and promises. PASS THE WORD TO PASS ON DANTE100!

Micro engraving my a$$... I prefer an oil based paint pen. Nice and sloppy. At least you are only out the $40 bucks or so. It could have been worse... Be sure to leave him some appropriately negative feedback.

All is not lost yet...Stick to your guns, very politely inform the Ebay agent that he is not being honest. I truly believe you will receive a refund still. I'm guessing this is not the first time he has tried to pull this crap and they will be able to see that in his history.

Dear waltgwbooker,

You can fabricate RED FLAGS all you want ,my 100% feedback goes a lot futher back than yours . Why would you ask for a refund before returning the item? It has never worked that way?
Especially since you and the so called (928) FORUM has me RED FLAGGED? I have always used an engraving which is not pictured ,as we don't engrave until it's sold! For you to call me a liar after I was polite and happy to refund or replace the item? and stated so over and over again while you expected a refund before returning the item??
As far as the engraving goes , I wanted to see if you (as most honest people would) return the item shipped regardless of the photo's you provided. This is the only reason I have escalated this case. $35.00 do you really think I'd go thru all this ridiculas-ness wasting this much energy and time?
Try reading my feedback as far back as 2005' I'm known for helping my customers ,providing info and insight on installations and tech info. I always sell using part #'s /which is takes time to research to make sure my customers are well informed.
If your 928 FORUM buddies have bought from me and have had a bad experience WHERE IS THERE FEEDBACK? or like you did they provide Neg. Feedback disguised as a Positive?

I had a completely different experience with Dante100 where he was helpful, shipped me exactly what was pictured quickly, and was prompt to respond to other parts inquiries I made with him. The item I bought was a console Hazard light switch. Maybe I was lucky. I now want to pull it out and look for the micro engraving thought

It sucks that you've had this issue with him, but I didn't.

Pete,
It's not too much to pull it out, I'm sure that we are all interested in if there really was micro engraving on all of the parts that were shipped out.

My Ebay experiences have been great to terrible. I always use the CC because they cancel it on my word. Then it puts the owness on the vendor to prove me wrong. So far not one that I have canceled has made the claim against the CC.

Default Get Your Money Back through eBay

The guys name is Dante Fabiani and he is out of Florida.
I bought a parking light lens that, from the picture, was not flawed. It cost me $35. When it arrived, it was packed in a layer of bubble wrap and shoved tightly (box being distorted type of tightly) into a single serving cereal box (the kind found at a diner or cheap hotel continental breakfast.
When I advised him that it was cracked in two places due to possibly being packed tightly (and subject to all the unknown packages it encountered on its way to N.Y. from Florida), he told me he would refund me only if I sent it back to him.
I sent his original package back to him in a larger flat rate box so he could clearly see the one way damage and it wouldnt be further damaged on its way back to him.
NORMAL PROCEDURE UP TO THIS POINT.
He advises me that he received the part but WILL NOT honor the refund offer (for $35 dollars!) because he claims its not the same part I bought from him.
He seems to believe that as expensive a 928 can be, I, with almost 800 transactions with feedback (more like 900 total) and a 100% feedback rating (mostly as buyer), would go through all of the trouble to spend $35 plus the $5.95 for return shipping to cheat him out of the original $35 part.
The reason I make this known is that he seems to have a lot of 928 parts and I felt compelled to give the forum a heads up in case some of you consider him as a "vendor".
If he cant stand by a simple incorrectly packed cheap plastic part, what will he do when you get a bum transmission?
Like you, I've purchased a ton from eBay with great feedback but lousy people don't care. I've been through this kind of thing (not with car parts) just recently.

Open a dispute with seller through eBay - they are actually pretty good at following up. If by chance you took any pics of the defective lens before returning it-include those which will help speed things along in your favor! If eBay doesn't find in your favor for some reason- call the customer service number and roll through the options until you can talk to someone live.

You'll get your money back if persistent. eBay pays you as part of buyer protection if the seller balks.

Hopefully the seller supplied you with a shipping label to return it because that's their duty.

It's maddening to have to spend one minute on this stuff-most sellers are pretty cool about returns on non-electronic items in my exp.

Good luck!

GOOD!

I just posted a long response on following up before I read it was resolved.

What strikes me as odd is that you trashed this guy while still pursuing the return through normal channels and, in the end, you got your money back. A total overreaction and over just $35.
