I was thinking the hospital bill was going to be $20k to 30k, but hitting girls is off limits.

Good luck with the fix.

We yelled at a chick on the phone that almost whacked someone at Hershey, she actually came back and said it wasn't HER fault. After she ran off again we realized she had been driving the wrong way on a one way feeder out of the parking lot.

I would have a good shop take a look at it and make an estimate. I would demand a new bumper cover because the dents won't go out and filling and sanding devalues your car.

Demand a brand new tail light, bumper cover just needs to be repainted.
I would recommend it be removed, stripped and redone properly.
Bumper shocks will be fine as will everything else.

And instead of suing her *** off, maybe say to heal the emotional damage to you, and to inflict the right amount of damage to her just demand that you have a few nights alone with the girl being allowed to do whatever you so chose with her. Unless she is ugly as sin of course. That should inflict about the right amount of emotional scarring to her to ensure she never do something so stupid again.
Oh if only the law worked that way!

When you consider that after the insurance company settles with you for this they are going to put something in the history of your car that says "previous damage" and that is going to show up when you or anyone does a records check with your VIN. How much do you think that is going to affect the value of your 928?

That is called diminished value and is a part of your claim. You can find an apparaiser in the yellow pages who will come and look at your 928 and give you an opinion of the diminished value. The catch is that you may have to have it repaired first.

Your basic claim is much like suggested by others in this thread, but I suspect it is a lot greater that most think. I would insist on a new bumper cover and that may be about $3000, and on a new tail light and I would guess that might be about $800, more or less. Then the labor and paint will add another $600 or so. Add to that the down time while waiting for the new parts to come (estimated time of one to two weeks) so you add the cost of a rental to the total for about $50 per day for something nice and sporty and you end up with a basic claim of about $5000. I doubt that the insurance company will bat an eye over that. When it comes to the suggestion of the additional diminished value they will be pushing a freshly written check at you for the $5000 real firmly.

Then you can give up on the diminished value and buy a nice tail light on eBay or from someone on this list for upwards to $200 for a real nice one, and get the bumper cover repaired and painted for about $500 max and then buy another S4 with the money that is left over.

That is almost exactly what I did a while back when I had a very similar incident with the front of my S4 in a parking lot. I bought a very nice hood on eBay for $150 plus shipping and will fix the front bumper cover and include that in painting of the whole car which it needed anyway. I used the rest of the $5400 money they paid to buy a pretty nice S4 on Ebay which was said to have a knock in the engine, but which actually had a rattle of the front of the engine which turned out to be the water pump which I changed myself and have a nice daily driver.

Don't let them off too lightly.

At $5K, you are going to be close to the insurance company totaling the car. That seems a bit over the top for a broken taillight and some minor body damage.

The values of these cars have nowhere to go but up!

Anyone who is shown the repair records will know if it was done right or not.

Exactly, the reason insurance rates are so high in Californiastan is due to this problem. Was anyone injured, was there mental distress, was something priceless and irreplaceable fubar? Nope, so just let Johnny Law do what he is going to do and let the insurance pay for the repair. It's and expense that should be used when needed. I love watching judge Judy, especially when people sue for damages on cars when they don't want to use their insurance in fear of their premium going up. She always, always throws out the cases. That is the whole point of insurance in the first place. /End Rant

That bumper has been repainted before. Factory paint doesn't peel and lift off like that.

Lets be reasonable... Its a broken tail light and some minor paint flaking. I bet your out the door for less than a grand to get this fixed. I was involved in a rear hit because a girl was talking on her cell phone and the insurance company refused to buy any new parts. There claim was the car is not NEW therefore you get used parts. I didn't have the energy to fight them tooth and nail and to be honest it didn't need a new cover anyways because the damage was so freaking minor.
