I'm not a lawyer, so listen to Big Dave on this, but if the Ins Co. cut you the check, then I agree that you are SOL.

But if the Ins co. paid the shop, I believe the Ins co is still on the hook to get your vehicle repaired, especially if you continued to pay your premiums. How bout it Big Dave? Does he have a case?

When the shop received the check, you became a creditor. You were owed either the cash (to take it elsewhere) or the work. Either way, it was a "debt". When the shop filed for bankruptcy, it was required to list all of its creditors and debts. When the shop emerged from bankruptcy, its debts were erased. Now, there are many exceptions to this general statement, but if you did nothing when you received the notice of the bankruptcy (like file a proof of claim), I'm comfortable saying that whatever the shop listed as owing you was discharged. Putting on my lawyer hat, I have to say that there might be something buried in the case paperwork that could salvage something for you, but it's doubtful that it would be cost effective since doing so would require you to hire and pay an attorney.

That being said, if you tell me the name of the entity that went bankrupt and where it's located, I could spend a few minutes looking into it.

Smurf if you are looking for a body shop that can do that car there is one here in Ellsworth. Believe it or not, there is very high profile shop just 3 miles from here with state of the art tech. It's called Time Machines Unlimited Inc. 1-231-588-2120 If you ever have work done out there be sure up front what is to be done and to what extent. And for anyone reading this thread if you are ever up here a trip to the shop is worth it. They love to have people come out and see the whole shop. They often sponsor lunch stops for Great Lake car tours. There have been some days that I see 20 Ferrari come through town.

My estimate was low, because I was really talking about just getting the car back on the road, and looking "decent".

Yes, if you want to do it right, and get it completely redone, you might as well buy another 928, and put a Jacquemond kit on it. With the savings on the interior repairs, body repairs, mechanical repairs, you could easily get yourself set up in another car...

My point is that it would be sad to see this car go into the junk heap, since it is so unique...

My thought was to patch it back together, and clean up the interior a bit, get another set of wheels and tires, and get the thing moving again.

Then decide what to do with it.
Sell it, keep it, etc...
But it would be nice to keep it on the streets.

I think this one should be filed under the "you snooze, you lose" category.

I can't image letting a repair drag on that long without taking intervening measures.

Just my opinion.

If it were mine I would surely fix it. You would need a place to work and some time, but you can control the cost by doing much of the work yourself and getting parts off ebay. If are careful and there is only the fender, door, and quarter you should be able to do it for under $3k(body and paint) without working too hard. $1.5K if you are really willing to work, buy some tools, put in time, and learn some skills. Even at $5k I would fix it since I doubt you will be able to put 5k$ with what you can get selling the car for scrap and get yourself a nice car. Snag a door and fender off ebay for around $600 altogether...they are pretty easy to change. You will swear a bit, but then you are already swearing. The tough part will be the rear quarter. You could graft one, but if it were me I would try really hard to pull it out. I would do it myself but for the less demented I would recommend changing the fender and door and then taking it to a reasonable body man and telling him to pull the quarter, then touching up and repairing the body kit yourself, the taking it back for him for paint. Should be able to get a reasonable job for $2k tops($800 quarter, $1200 paint). Pay him after he does the work. If you really want to save money at the expense of time you can pull it your self. You will need something to pull against (a tree, or something) and a come-along. You can also jack it from the inside. You will need a body hammer kit and a angle grinder (available from Harbor Freight for cheap). Friends and beer are helpful also. You will have to learn the skills as you go, but there are good books, and there is not much to lose since you can always graft a new quarter on there if you screw it up too bad. The fiberglass work is dead simple. Smells bad and makes you itch, but not hard at all. Paint is always the toughest issue. Its almost as hard to do a good job yourself as it is to find someone else to do a good job for cheap. But can surely do it yourself...if it is only the one side. You will need $350 worth of compressor, gun, resperator, etc. You dont need a real booth....just a little tent big enough to keep dust out of the area you will be painting. I would paint the new fender and door seperately while off the car.
This is not a small project...figure a year...working on it something less than one day every other weekend. Much of the year will be spent waiting for parts to come up on ebay and trying to work up the guts to try that quarter one more time. And it will be frustrating. But then you are already frustrated and you have already waited a long time. When you are done the car may not be quite perfect...but it will be yours in way that it was not before and another car would not be, you will have learned some stuff, and (if you are warped like me) you will have had some fun, and your $ investment will on the order of a week in Hawaii.

Smurf I agree with Karl. If you can keep things under control you might be ahead to do the work yourself. I hope that this works for you. And on the other side, if you chose to part with the car let me know I am falling in love with the style of the rear. I would love to tackle that car as a two year project.
