I don't think it would be any better for him if his insurance company had insured him. His insurance company would settle for whatever without any input from him. Then he'd have to argue with his insurance company instead of the other guy's.

Because his insurance company KNOWS that the other Insurance company MUST pay them. Comes under subrogation I believe. It also allows for a second opinion which might be better and dealing with the company who has been collecting your payments might just possibly be better. But maybe the point is as an individual without collison coverage it is just you against the other insurance company with no provision for arbitration. Sure you can sue them but that may take 2-3 years.

In the accidents I have been involved in, I have had no collision coverage, and I have not had the slightest sense that the other guy's insurance company had some advantage over me since I had no insurance company representing me. It simply was not an issue at all. The negotiation about value would be the same unless there was some special pre-arrangement about that. If anything, I felt like I had a big advantage since I was negotiating with a party that had been declared guilty.

Sorry... don't have time to re-read through all of the posts, but Candleman, do you have your own collision coverage or not? If you do, and you don't like what the pool co's insurance offers you, you could file a claim with your own insurance company. As Jim Bailey said, your insurance company will (likely) then subrogate the claim, i.e. pursue it against the other insurance company. The upside is that you'll almost certainly get this handled exactly how you want it, assuming your insurance company is worth its salt and cares about your business. The obvious downside is that your premium will probably go up; you could ask your insurance company whether that's what would happen though and they'll hopefully tell you.
I had a similar experience a few years ago that nearly totaled my 2000 Saab 9-5 Aero (got clipped coming off an exit ramp, and got spun around in the rain at 40 mph, into a light pole; not totalled, though! I even drove it home). I didn't want to deal with the other person's insurance company after talking with them about my claim (they were trying to deny liability at all), so I just filed a claim with my own insurance. I asked them (USAA) if my premium would increase and they said it wouldn't. And it hasn't, other than normal annual cost-of-doing-business increases. Not sure if they pursued subrogation, but I assume/hope they did as my repairs ultimately exceeded $14k, on a then-$12k car.

Bill my "negotiations" with the BMW a few months ago ended with the insureds company making a modest offer and suggesting that I have three years in which to sue them and attempt to prove that my loss was greater...They suggested that I settle with my insurance company and that they would then be required to pay the bill....however since I too do not have full coverage.....that is NOT an option.

A small victory for me, I got more than I paid for it. Still a minor consolation if you ask me. Trying to find a fitting replacement that pleases me in so many ways is a depressing notion.

Very positive result. And the biggest consolation is that you're not dead. What if the punk was moving through the intersection 2 seconds later? Truck vs. side impact on a 928... truck wins. It's only stuff... no matter how much passion we have for these cars, and we all obviously have a lot, it's still just stuff in the grand scheme of things, and you can't take it with you. (but man I wish I could! There's gotta be a perpetually empty and cop-free autobahn in heaven, right?)

Hahaha, I'm sure there is... Yeah it's a good outcome, better than I could have expected. Maybe if I had owned my car long enough I wouldn't mind the waiting and searching for a new one. It took me 8 months before I found mine (oh... the green over tan... ) and now I'm jonsing for it one and too many of them I see online are looking more desirable than they would otherwise be. I'm just bitching now, really it's not that bad.
