I think I would formally sue & serve papers on the Sherrif to stop the sale of a car- not just call them. I don't see how they can sell a car with pending litigation. Time to get the Lawyer involved & stress to him the urgency - it can't wait until later.

I have been in communication with Black928GT. As I let him know, I have never had possession of this car as there was no title. Other details will have to wait as the various legal proceedings move forward.

In my case, always loved the 928, but never had one. Seeing as this is ten minutes from my house, I think I have to go, even if just to observe.

What do the insurance companies have to say about the situation? Has anyone received a payout for their stolen vehicle?

Will all of these cars have "Branded titles"?

This story has more wrinkles than a bucket of Botox can smooth out and I hope all of the victims can be made whole when the dust settles...

I believe the argument will be that the car is not part of the bankruptcy estate. That is, Juan Doe did not transfer title to the car and that Juan still owns it. There are several possible defenses to such an argument. Some of them are factual and others are procedural. From what little we know, the argument cannot be simply dismissed as without merit. For example, if I were to take my car to a garage for work to be done on it, that simple act wouldn't transfer the title to the garage. If the garage goes into receivership while the garage still has it, that doesn't defeat my title to the car. However, let's say extensive work had been done on the car and a mechanic's lien is in place, that might defeat my title. Even then, I should have the right to contest the validity of the lien or to satisfy its requirements such that the car is returned to me. My point: Some of the 'owners' of these cars may not be unsecured creditors.

Default 90% there Will not be an auction

From Forsyth County Sheriff office,
The whole thing is over a monthly lease payment that turned into $8,000 plus with lawyer fees and associated cost. The cars were the only thing of value to levy by Sheriff Department. 17 cars were levied 7 cars returned to owners from Sheriff contacting them. 10 cars slated for Auction. That number is now at 8 cars slated for auction.

The statement was that
Any owner that has a grieviance with Garage 928 should contact Sheriff's office directly. Currently there are no class action cases against the garage of it's owner.

Building lease or an automotive lease? I'm assuming it was a building lease since RVM had moved shops more than once. Leases can get ugly very easily, especially if one fails to pay or fails to find a reasonable solution for an early exit. I remember reading in a thread that something like that had been hanging over him for some time.

One take away... if you can’t get your car back from a licensed shop start the legal proceedings promptly. I know in FL the majority of applicable law goes against the shops and favor the consumer. Hindsight is always clear but I wonder how so many people put up with being denied access to their cars for so long. I wish all of the victims luck and success in their recovery.
