Property release damage claim language

Default Property release damage claim language

Last week someone backed into my car, their ins. co has handled it in a manner satisfactory to me and 2 checks arrived today.

However I'm curious about the wording on the release....

"It is understood and agreed that this settlement is the compromise of a doubtful and disputed claim, and the payment made is not to be construed as an admission of liability on the part of party or parties hereby released, and that said releases deny liability therefor and intend merely to avoid litigation and buy their peace."


Doubtful and disputed???? That's the first I've heard of this ****...

Is this standard CYA or do they really think I'm trying to screw someone on this deal?

AFAIK.. It's a standard and conditional response of release- just means that by accepting your check you cannot go after them for further damages in court.

Keep parking it there, eventually you'll be able to get that 968 Paul.

Just a standard release and indemnity. Wording is kinda mooky but it works. Basically in layman terms it says "By cashing this check, this claim is settled and I won't go after the issuer and their associated parties, and no one admits any fault".
