Default Fuel transfer tank on open trailer?

I've been considering adding an aluminum transfer tank to my open steel trailer. The trailer should have the additional capacipt and I have room to move the car back to balance the load but does anybody know if it would comply with federal and state laws?

We have an RDS fuel transfer tank/toolbox combo. It's model 73851. I like it because it doesn't look like a transfer tank (the pump and fill are enclosed).

The tanks have DOT certification for diesel & gas.
