Car is back up for sale. Buyer and I agreed on a fair price, deposit received (refunded), but he could not do the in/out with my BMW dealer.

This has to be a private sale. My dealer cannot wholesale it to your dealer. And sorry, I'm not interested in selling to a Dealer for resale. Thanks guys.

Hey Noro,

Let me rephrase...

My dealer will not wholesale my car to your dealer or any dealer. Basically, like in most transactions they are forced to charge the legally appropriate amount of tax. Dealer to dealer wholesale transfers are without tax (this occurs thousands of times per day). But for an in and out to work, you and I agree on a price, the dealer buys the car from me (I trade it in) and you buy it from them. Therefore, you must be a private party as if you walked into a dealership and wanted to buy a car.

Sorry for the confusion.

I am probably annoying everyone on this thread with my tax question but I think it's good to get the story straight for even your own sake.

Are you saying that unless your dealer charges sales tax on the GT4 they cannot give you a tax break on the trade-in? (you getting a credit is what all of this is about right?)

If so, are all those claims above that out of state purchases would be tax free bull _****? If not, as in no sales tax is charged for out of state purchases why would it matter if this is a private or dealer to dealer transaction?

Hey Noro,

No it's worth clarification.

The ability for me to get a trade-in tax credit and your ability to buy from my dealer are mutually exclusive. Just imagine my car was for sale at my dealership and I wasn't involved. Unlike with many other smaller or non-corporate run dealerships where wholesaling or shuffling paperwork to get a car from A to B is daily business, my dealership does not or cannot wholesale a car to you or another non-Sonic owned dealership.

You are correct...those living in states that don't charge tax on private to private car sales (whether in-state or out-of-state), this deal would not benefit you. You are buying the car from a dealer.

I hope this clarifies.

Here's another option to consider that would open sales to more parties.
Take the amount your dealer offered as a trade, add 6.25% to cover the sales tax savings and offer it for that amount in a private sale.

His dealer has no trade-in offer... that's the point, it's an in and out sale so that get gets his private party asking price + the tax credit.

1. Do you think my car is priced above market value?
2. Do you think most buyers are from tax advantaged states and are looking for only a private to private deal?

Hey Noro,

1. You can trade your car into my BMW dealer and get a tax credit towards the purchase of my GT4. That's for sure.
2. My private party selling price will be less than what the dealers are charging so I'm not trying to take advantage of the potential buyer. If anything, avoiding the painful negotiation with a dealer and just having them do the paperwork makes the process very easy (most times).
