Seems unfair but I believe NFI really helps to reduce the burden on the already over loaded Canadian legal and courts system.

No, that is how no fault works,
if they sued it would be regular at fault insurance.

Dart driver is at fault and the dealers insurance company pays???

In the insurance world they don't really call it sueing...but you can bet that whatever company holds the policy for the dealership will subrogate against the other. They will go after their money if the police report defines clear fault

It will be fixed...

This 959 I've been stalking suffered a similar fate(although not as bad), been at the bodyshop for about 1.5 years.

the Ferraris have (I believe on the F40) carbon fiber frame and monocoque chassis which cannot be repaired if severely damaged. The 959 is beautiful but a different beast alltogether.

Nope...Gas Monkey Garage restored a F40 last year:

They didn't restore anything - it was a bodged up, bend it back and see if we can get 65% of the value back after. Great entertainment - lousy work. That car required a NEW chassis. Bending frame rails back that are way out of place, cutting out, welding in pieces??? OMG. It was a salvage title job that might meet the DMV spec's in the US but I'm sure factory technicians back in Italy threw up on their monitors when watching this...
