I do not know how many here or if you have had dealings with the legal system (lawyers and courts), but according to my friend who is going through all that, it is a waste of time. He has been at it with lawyers for at least 2 years which includes all the processes and his court date is in about another year. Then think of the costs. I have another solution, but I can't print that here.

OMVIC gets $10 from every buyer of new or used cars in Ontario . That's a lot of money to build a nice bureaucracy and pay its executives very well
and like all "consumer protection agencies " its not about the consumer . The consumer is very low on the list of priorities..

My guess is OMVIC spends more on protecting itself than they spend reimbursing consumers from their compensation fund . Lots of precedent for that with all of our other protectors..

The other side is everybody in the trade has OMVIC as their overlords . One of the many reasons its hard to make a honest buck.

In this case it seems the consumer has a strong hand and is resourceful . Small claims court now has a $35,000 limit in Ontario . You can do this yourself .

What I'd like to know is if it is a legal requirement set out by the provincial government when buying a car. If not, then I would tell the dealer to FO.

pretty sure it is a requirement to pay the $10 omvic fee when buying from a dealer in which they need to be a member of.

Not really. You can really tell them to stuff it. This OMVIC is not mandated by the provincial government. Sort of like the BBB and we know how useless they can be.

OMVIC receives no government funding. Its revenues are predominantly derived from dealer and salesperson registration renewal fees; the transaction fee is a part of the dealer’s renewal fee. Here’s how it works:

Registered dealers must pay to OMVIC $10 for each retail (including fleet and export transactions) sale or lease. This money is remitted annually along with the dealer’s regular renewal fee. While not all dealers pass the transaction fee on to their customers, it is allowed and many do. As of October 1, 2015 the transaction fee increased from $5 to $10. Not true. Every used car dealer is required by law to be a member of OMVIC and OMVIC has mandated the OMVIC fee on all used car transactions. It is NOT optional - every used car transaction by a registered used car dealer incurs the OMVIC fee. OMVIC IS indeed mandated by the provincial government - they are the provincially-designated authority to administer the Ontario Motor Vehicle Dealers Act. From the MVDA:In case of any concerns with this sale, you should first contact your motor vehicle dealer. If concerns persist, you may contact the Ontario Motor Vehicle Industry Council as the administrative authority designated for administering the Motor Vehicle Dealers Act, 2002.

Fair enough...found this on the OMVIC site. Yet when asked via an email to OMVIC, the person responding made no mention of it.
OMVIC (Ontario Motor Vehicle Industry Council) enforces the Motor Vehicle Dealers Act (MVDA) on behalf of the Ministry of Government and Consumer Services.
For the thread starter, this might be useful. I can't stand the word "may" used in the document. It should say "will". Typical protect yourself BS.

Also it was interesting that there is no law about curbsiders unless the vehicle has been a write-off, etc. So theoretically curbsiders are allowed except in the eyes of OMVIC who gains no $$$ from them.

Immediately file a law suit against all parties and push for fraud, which it is. They'll all countersue each other and the pressure and expense can push them to quickly resolve. Your family member will be probably be out some money realistically.

Yeah thats what i said . Sue the dealer, the person at the dealer, the person who safetied the vehicle. They'll all want to run from each other, include punitive.

For anyone following along, OMVIC said that yesterday they made a request to the dealer to take the car back and issue a refund. No response from the dealer yet, so we shall see...
