Help! Need legal advice???? long

Thumbs down Help! Need legal advice???? long

I have been to get my 500.00 back from a Rennlist sponsor for about 10 months. I bought a set of what was sold to me as a set of 1981 P/C for my 1979 911. Being a newbie with 911 engines, when I received them I asummed I had received the correct parts. Plus the fact of what "25 years experience can do for me" I had no doubt they were the right parts.When I took my engine apart I discovered that he had sent me another set of 1979 P/C. I contacted him and after about a month of going back and forth he agreed to exchange them for the correct parts.I returned them to him. I waited another month and contacted him again at which time he told me he didnt have a good set from a 1981. So I asked for a refund. He told me no refund because he had sent me a good set of p/c. I agreed except he sold me a set from a 1981 which is what I odered(higher compression)and he sent me a low compression set. He says he will look again for another set but no refund. Another month passes and I receive a box with six cylinders with 3 different bore sizes and a set of 3.2 pistons. I contact him that that even with my little 911 engine experience know that this will never work in my car.He tells me to call his helper and discuss it with him. So I do, and tell him I am sending them back and want a refund. He says fine send them back. In which I did. Now I wait another month and hear nothing, Dont return calls or emails. So I file a complaint with better business. They send me a letter stating he does not respond to them either. I contact my credit card company. They send me a letter saying since it has been over 90 days they can do nothing. I file a complaint with Georgia consumer affairs and the say there is nothing they can do except make a note and keep an eye out if he has any more complaints and they tell me I will need to contact the county court in his county and make a complaint. My question is how can I do this without going down to Georgia. I live in New Jersey? Can I file a complaint by mail? What other options do I have? Or am I just going to get ripped off for 513.00? Any Input would be greatly appreciated. Thank you Joe White

Why are you keeping the NAME of this sponsor a secret? The best thing to do is publish his tactics on every board you can find with identity. When his pocketbook starts shrinking because of poor business practices and deception, I'll bet you get some action,if not he loses more than you in the long run.Just be a bit smart in your posts and don't make any unfounded claims.best,jim h <img src="graemlins/wave.gif" border="0" alt="[byebye]" /> <img src="graemlins/oops.gif" border="0" alt="[oops]" />

Thanks Jim that is a good idea. I was just trying not to get myself any grief buy stating his name. I thought the "twenty five years experience" and the fact that he is in Georgia would be good clues. But you are right P.A.P Parts should be mentioned so that fellow rennlisters can be cautious with dealing with him. And the fact that Better Business has several unresolved complaints with him show how much he cares about resoving problems. Thanks to all who have responded.

Thanks for the heads-up Joe. This isn't the first time that someone has mentioned bad-service from PAP-parts on this list.

BTW, did you used to race bikes here in California?

Because you are out only $500.00, and I use the term only in light of what it would cost to litigate, your best bet is with the Attorney General of Georgia. You could also file a complaint in Federal Court in New Jersey alleging fraud, breach of contract etc. You can sue them in Federal Court because they do business in your area, i.e., their business is not confined to just the State of Georgia. Is it worth the effort and expense? only you can decide. If I were in Jersey I'd dfo it for you. Go after the bastards....there a bad name for all in this business. Lou [Cleveland, Oh lawyer]
