Is there a logic that really low mile 2007/8 might be worse then a 60-80k mile car?
Does lack of driving hurt more then a car that is driven regularly and has more miles?

It depends. The recommended maintenance schedule has mileage and time recommendations. If a car has low mileage but it hasn't been maintained according to the time schedule, then it could have some issues. A 2007 car with less than 5,000 miles on the odometer that has never had the oil changed has many potential issues.
I think you should decide on your list of priorities for the car (model, options, equipment, etc.) and the maximum mileage that you are willing to accept, and then see what turns up.
I still think you should consider the 996 turbo given your price range.

OP: An '04 is a 996, probably better to ask about that one on the 996 forum.
Mid-'05 on through '08 are basically the same car, so condition, options and color would be top criteria. Mileage is a double-edged sword. Garage queens have their issues from standing around; high-mileage cars, things do wear out.
Early '05 has replaceable IMS bearing, later ones almost never fail. All these engines are subject at some unknown probability to bore scoring. I had my IMS replaced proactively but bore-scoring took the engine out. Even had that not been the case, it still needed lifters at just over 60K, which is a roughly $6K job if you don't have a warranty.
Frankly for the top end of your budget ($45K) I would only be looking at '09 cars, which are 997.2's.
