Default If my VIN isn't in the IMS Class Action Suit am I safe?

Some of the recent reports on IMS failures on later year cars has got me worried again. If my '05 S VIN is not on the covered list in the IMS Class Action suit, can you be relatively assured that the car has the newer bearing? My car has 57k miles, so I was a bit reassured since it didn't happen earlier in it's life.

Do what I do and not worry about it. If it's keeping you up at night look for a good extended warranty. If that doesn't help and if you have the funds, trade up to an 09 which doesn't have an IMS.
