I would think so.
Our home in N. Georgia is zoned agriculture (16acre) and we have agri-diesel delivered for our so-called urban farmer tractor. I would never use the agri taxed diesel in our late model VW TDI, besides one look and the distinct color would be a easy give-away .......
That said, my MkV MTM Tuned TDI has the VW Eibach/Bilstein suspension bits, R32 brake upgrade, VW/BBS wheels, etc.. I don't suppose the tax man would see it in his heart to make allowances ..... LOL.
