I think I'm just paranoid and will buy from a dealer instead. Cost a few extra perhaps, but this is looking to be a hassle.

Are either you or the seller AAA members? You might try contacting them for handling this since they can handle most all Calif DMV services. They may be able to guide you in the process.

When I bought my M5 from private party, I cut cashier check to BMW Financial Service directly. Seller never sees that check. I had to wait 2 weeks but BMW Financial got me the title with no hassels.

What I do as a seller is take the check, take it to the bank, let the buyer drive on my tags until I get the title and can send it to him. Obviously I give him/her a bill of sale. That way I figure eveyone is protected.

Dealers are claiming they would have to "buy" car, put it through checks, etc since they are "licensed dealer"

Bought a motorcycle 2 years ago, seller seemed honest, took my cashiers check, cashed it and never paid off the lien holder and even though I had the bike I couldn't use or register it for over a year. Had to sue the jerk and spent nearly $1500 in attorney fees.
I wouldn't necessarily drop the deal for this car since you apparently like it enough to want it but make the check out to the lender, never to the seller. Confirm the lien holder off the registration, it's printed on it.
