Rob,

Vinny's advice is very good - follow it. Obviously a man with (almost) as many speeds as me.

Tom is also correct. You can save probably $100 a year or so if you take the NYS defensive driving course. You have to be the insured and principal driver for the car. Mine is owned by the company, so it will not benefit me.

So four or five hours on a Saturday or a couple of weekend nights will net you.... about $300 over three years, Don't hurt yourself running out the door to sign up. Of course, that supposes that the insurance company gives you the 10% and DOESN'T bone you 12% for some other rider. Of course no insurance company in NYS would do that....

Of course, you could use $35 of that money a year to get a Rennlist membership. So could Tom for that matter.

Actually, Rennlist membership is just $17.95 per year ($32 for two years) which, of course, is a small fraction of its value.

Update:
I followed the above advice and made a polite call to the DA. He asked me if i had any other points on my license. I said no. He then said he would accept a plea of "failure to obey a traffic control device" - this is 2 points.
He said he could not accept the ticket as a nonmoving violation.
He said he did not think this would raise my insurance.
Any other thoughts, or should i just accept this??
thanks,
rob

If this is your only ticket within the last 39 months (based on CONVICTION date) than it is non chargable. The first minor is non chargable and every minor thereafter is chargable (2 insurance points, which is a different point system than dmv's point system).

I don't believe that Tech-Law's advice will work. The officer or trooper will tell you to have your attorney contact the county DA and ask for a reduction to a non-moving violation. I have never been successfull dealing with the officer involved. And I have had SCORES of speeds in Upstate NY....

You may have to have your attorney contact the county DA and plead for reduction using the usual stuff.... my client drives a lot, insurance rates, first speed, blah, blah.

Email me with the details or, better yet, fax me a cc of the ticket. My fax # is 315-255-2889. Blow it up so it's readable and mark attention "Mike Cap" in the corner. Put your office or cell # on the sheet. My office # is 315-253-9721 x 106.

Was at the Glen on Sunday with my son and did the parade laps. Assume you were there as well.

Happened to see your post. Don’t know any attorneys in the Southern Tier of NYS. You might call the Town where you’re supposed to appear and ask the Town Clerk for a local attorney recommendation for a DMV issue. They are usually pretty friendly and helpful. Good luck.

Depending on your insurance company, points assessed will raise the rates and will remain in effect for 3 years. Best check to be sure that the infraction will not affect your insurance.

Does Hancock have a "Deferred Prosecution" program? Do you have a spotless driving record?? Go into court, ask the state's attorney for DP, and if granted, they'll usually ask for about 1 hour of community service per 1 mph over the limit. Worth a shot. No fine. No fees.

Not sure but I'll ask. That's what I put in my plea letter for now.

27 hours of community service in Hancock? I'd pay the insurance surcharge!

Good luck with the DA. I recently showed up unrepresented in traffic court, and the DA allowed everyone in the room with no points to cop to a $150 fine and no points.

You went to Hancock? I'm not sure what to do. Either go through the DA with plea letter. Or lawyer up. I spoke to a lawyer. Scott Russell law. $300 says he thinks he can get half the points and maybe fine. Its high 90/55. He said the plea route might get me a minimal reduction and that's it. Even with court. I don't drive so no insurance. Except for work. So trying to keep a clean record.

This is why i always drive with Waze running.. social powered cop detector and i have mine set to ding at me when I hit 10mph over - simple reminder to dump it into a high gear and cruise - I try to diver public speeding costs to the track

I would also prioritize getting out of having something on your record vs dropping the whole thing - more likely and you were speeding.

I've had a few tickets in the last few years, not many, but an unfortunate few. My mantra is ALWAYS hire a law firm - you will almost always get a reduction if not a full removal of any pts, with only a nominal fine to pay, making it worth it from an insurance point of view at the very least. Don't think of this incident as only one ticket, but one of possibly more, hence my approach.

I drive this highway often on my way to Canada. I use a combination of Waze and portable Escort MAX. Between the two it's saved me countless times. so I highly recommend doing this. I have one example where neither worked: I was stopped once by laser - there aren't many of them using this, but I expect ones using it will increase. I was coming over a small hill and the cop hadn't been 'made' yet by a Wazer. Was doing 92 in a 65 zone (in this case on I-81). I pulled over right away when my Escort went off, as the moment the detector detects a laser signal it's already too late, he was very lenient since he didn't have to chase me and only charged me for doing 76 in a 65 (Phew!!). This was still 3 pts and a fine. Despite his leniency I still took it to traffic lawyers and the pts were reduced to just 2. This was the most I could hope for since the officer was already lenient I was told by the lawyers. I've had other tickets in the past where the points were completely removed using the same traffic lawyers. By the way, thanks to traffic lawyers I have maintained a clean driving record (these are the only pts on my record).

The company I used is Rosenblum Law Firm 888-883-5529. At worst just call them to discuss your predicament and hear what they have to say.
