I have seen anywhere from 5k for cars that are above 100k MSRP to 10% once an allocation is confirmed at different places

At least they are giving you MSRP, so all in all not too bad

I had to put down $25K (nearly 10%) for my 22 PTS MSRP allocation. I was a first-time buyer at this dealership although I did service my Audi's there.

Some dealers have a cap on what you can charge on CC. Crossed a lot of people's minds banking points. My dealer would not take more than 5k on CC.
Anything more is certified (bank check or wire). Thought it was weird at the time only accepting 5k. Each dealer may be different.

My advice would be give them the deposit and make sure they confirm MSRP on contract with build date.

My first four PTS 992 tts's the dealership wanted a 25k deposit once the order was accepted, but was refundable, the last two PTS 992 tts's no deposit required

it’s enforceable in NY. Dealers will usually refuse to stipulate that in a contract. Their deposit contract is there to screw you, not them.

it’s not enforceable anywhere, to claim so you need some precedent.
show me a case where it was successfully litigated.

I had left a 20K deposit on my car with a sticker of 250K. I knew the dealer and have bought many cars from them. I had to cancel because part of the deal was the delivery date. The car kept on getting delayed, so I canceled it. I had to fight to get my deposit back. I did get 99% back the last few dollars they would not give back. I had given my old car which was less than a year old as a trade in, and they sold it for a profit. They lost my business and I will no longer give them any good recommendations. I have a lot of friends who have bought exotics from them, I told them the story, they were surprised as I was.

I had to put a 20k deposit on a MSRP Turbo S. But it was "refundable". I just had to build another car or buy something from stock if I didn't pick my build.
