Getting the deposit back without taking the car would have been complicated. It was not a TX dealer so I would have to deal with the possibility of suing an out of state dealer that was more than 1,000 miles away. I also had signed documents that indicated the deposit was non-refundable and took away an open build slot that they otherwise would have sold at the asking price.

I believe the deal will have a happy ending for all parties once it is finalized which I believe should be this week.

doesn't sound like a bad deal, my local dealer has a pts 252xxx asking 389...

A $252k MSRP RS? What the hell did they add to it? One guess...it's a dealer specced car.
