Post Rear-ended yesterday - not as bad as Phil (long)

This weekend, some friends and I drove up to Alton Towers in a 3 car convoy and stayed near Stone, Staffordshire. After having 'enjoyed' Oblivion, Air etc. we left for home (London area) on Sunday morning. We stopped at a Shell petrol station for the others to fill up and I was off on one side waiting fro them. I saw a van pull up behind me and he started to get very close, so I let off the handbrake to move forward in case he needed more room. As I let off the handbrake, I felt the van slightly nudge me and a small 'crack'. I jumped out and sure enough, there was a small dent with a small flake of paint missing and the bumper had a small half inch crack at the bottom where the lip is. It turned out that the van's towing point (the metal hoop sticking out at the front) had hit my jumper gently....

So i call tot he guy and say 'you just went into me'! He says 'no I didn't' and just walks past me and starts to fill up the van. I follow him and politely tell him that he did and ask him to come and have a look. He denies again that he touched my car and continues to fill up. At this point, his mate in the passenger seat gets out and I continue the comversation with him. He tells me that the damage is old and tells me to fu*k off. I ask him how he knows the damage is old and he tells me that because my bumper has a half-inch long crack underneath the lip that there would be plastic on the ground under the car. I argue that because it is a crack, that there is no surplus plastic to be accounted for. He tells me that I am a liar.

At this point, we roll my car back 2 feet and the towing ring lines up perfectly with the damage. Additionally, there is a very faint red stain on the ring itself. I take a lot of pictures of both vehicles.

As both guys are being very obnoxious and unhelpful and are refusing even to discuss it, we call the police in order to get some help with the incident. They basically refuse to attend unless someóne is injured. So we have now swapped details and my insurance company will pursue this on my behalf.

My feeling is that the van may not have felt the impact as it was very slight, but I can't understand the attitude of some people. I am now hoping that with the pictures taken and eyewitness accounts from my friends (that the towing ring lined up exactly with the damage) that I will be able to claim against the company (it was a Mercian company pickup/van). I guess it will take some time? Anyone have a similar experience and what happened?

Sorry for long post.

Sorry to hear about your experience.

This is just typical of third parties these days.
A few years ago a lady Jumped a set of red lights and took me clean off my motorbike. Extremely polite at the time and apologetic.

We exchanged numbers and when i phoned her a day later (The evening of the accident i was in the hospital getting a shoulder X ray as this had gone very painful after the shochk of the accident had worn off)

She then completely denied hitting me as she said had not felt the impact (I must have jumped sideways off the moterbike & lifted myself 8 foot in the air for fun)I suspect her husband or a friend decided to get her to change her story!

Lucky they were some witnesses but the Police would not get involved after the event as I had not called them to the scene of the accident.

It took about a year for my insurers to finally get her insurers to pay up as she flatly refused to acknowledge hitting me.

The moral of the story is do not trust anyone who hits you and if need be refuse to move your car or vehicle from being an obstruction whilst you have a sudden attack of injury just until thje police turn up to make a report!

I must (uncharacteristically) resort to profanities -

If you are hit by someone, 10:1 they are a complete a******e (that's a*****e for our American friends)!

I encountered one in the Isle of Man a week or so ago 'though, fortunately, no collision was involved.

A lot of you will know that my wife, Paula, has MS and has to use a walking-frame or wheelchair.

I decided to go for a swim at the sports centre. Paula decided to come to watch. With folding wheelchair in the boot, I start reversing into the 'disabled' parking bay near the entrance. In front of my, a large silver 4x4 rolls to a halt (he is leaving the car park).

As I look forwards, he assumes an irate look and gestures forcefully at the 'disabled' symbol in front of my car.

I politely-but-forcefully nod and continue to manouevre into the space.

He becomes downright angry and gestures violently at the sign. I once again nod and point to Paula (why do I lower myself to doing this? )

He gets even more annoyed at this AND SO DO I!

At this point, I lost my cool and went to get out and go over but, unfortunately, he drove off.

Not the first time this kind of thing has happened.

The only thing more annoying than finding someone who has no right parking in a disabled space is someone who decides you can't do so because of your car!

Christer, thanks for the excuse for letting off steam!

Yeah, these guys definitely fell into that category. Very abrasive and inflammatory.

I have now spoken to my insurers and they tell me that it is pretty standard that the police will not attend and that it shouldn't affect my claim...their legal department will apparently be contacting me tomorrow to go through this in detail.

I am just angry for all the hassle, I mean these things happen and although the guys were a couple of ******, we have all (or most of us) managed to nudge another car or had some sort of accident at some point. I guess I am just going to have to wait to see what happens - in the meantime I will put on hold my 'rust bubble repair' as I guess I might as well have this done at the same time...

Hi Christer, sorry to hear about all the hassle - I hate that sort of stuff. Time for an RS bumper maybe?

I guess was very lucky, the guy who hit me was fine (well, he'd have been even better if he hadn't driven into me...) and the whole thing was very amicable.

Hope your insurance company sorts it out - keep the pressure on them.

Good luck

Phil

Christer - - - really sorry to hear about your car - unfortunately, in today's world, people just don't take responsibility for their actions. I find it deplorable. Glad you were able to take photos.

Advice I learned from another forum - I now carry one of those deposible cameras in the car at all times. Never know when you will need it!

I was out eating and some people thought they were too important to find a real parking space so while they were ordering the Police happened to show up and write a $450.00 ticket to their dumb ***. And they only has 30 days to pay it. I had to let out a devilish chuckle.

Christer, sorry to hear of your mishap. I've never been rear ended in the Porsche, however, I've had plenty of people tell me to f*ck off.

Hey Christer,

Sorry to hear about this. On the upside, at least you have the information for the person who hit you, even if they're in denial.

It's not a P-car, but the wife and I came out of the store yesterday to find a nice scrape across the right corner of the rear bumper of her Honda. No note, nothin'. Looks like about a $200 repair, as the bumper wasn't dented (superficial damage). My luck has been especially bad, as two months ago, some $%#$! hit the center of the front bumper of my Porsche while it was parked, peeling paint and leaving a crease in the shape of a tow hitch. Again, no note. That cost me $400 to get fixed.

With regard to people who refuse to acknowledge having hit your car. Or, similarly, people who vehemently deny that an accident is their fault, even when it's blatantly obvious. I think it's a case of low self-confidence and esteem. They're so dim, and likely make so many mistakes as is, that they've convinced themselves that the rest of the world is f**k-ed-up. Accusations of their having been at fault or making an error are met with patent denial, oblivious to any sort of objective evaluation.

Good luck with getting the losers to pay, and with getting your car fixed proper.

Bummer. Sorry to hear this Christer and yep the behavior of the guys who did the damage sounds all too familiar.

It does sound however that you did the right things and made the best of a bad situation, getting their address, photos and fighting this through the insurance companies is the best I think you could do.

It is not as satisfactory however as other more physical redress might be, but unfortunately the police would be then be interested and I'd prefer it if the only thing wearing stripes were your seats and not you in some prison garb

Sorry to hear this, it happened to me before and basically I called the police and told them I was threatened by two guys and really needed help.( it was quite true in my case!). They turned up and those two were then much coopetrative. I do not understand why the police did not respon to you....

Sometimes you feel so frustated as the law is not really protecting the law abiding citizens...

Anyway, may be look at the bright side . You can think of how to replace and decorate your new bumber.

Regards,

Eddie

But do we want to think of Comrade Christer in prison stripes? I think not!

I had a guy swing his bag into my 911 SC passenger door a few years ago in central Stockholm

As I had done nothing wrong or offensive I got out of the car to have a look and ask the guy(55 years) what the f**k he did that for. I thought he had hit my rear right fender and I did not see anything. The guy walked away quick without listening to me asking him to stay and sort this out. As I was going back to drive away a woman by the car tells me the bag hit the door. I go around and see the two dents on the door I get her phone number and run to get a hold of the guy. I find him unlocking the apartment building door. He is still rude and denies he damaged my car.

To make a long story (one year) short, I found out his name and asked him to pay the repair. He did not even reply. I then sued him and won. He appealed and I won again
In the end he had to pay a lot of money for messing with a 911 and its owner

In the end I had the damage repaired by a "dent fixer" without repaint or nothing. Expense $90
