Help me get out of a Texas ticket

Jees guys, move along. Here in Oz (vic) we get a renewal notice from 'dmv' at least 6 weeks prior to expiry (which incorporates a windsreen sticker, colour coded for year), and there are two ways of paying on the web - direct to dmv on a credit card, or via a bank transfer. I schedule a transfer with my bank for a day or two before expiry, and apply the sticker close to the expiry date.
Technically you could NOT pay and apply the sticker, and get away with it for a pretty long time, but eventually dmv would effectively de-list the car in 60-90 days, and then to get it back legal is a major hassle, you would be uninsured to drive it, and open to lots of trouble.

I am not sure what you are getting at...
My car is registered in California for at least 7 reasons:
1) It is my permanent address (my wife is only STATIONED in Texas).
2) It is cheaper in Cali to register the car.
3) It is smog-exempt in both states while used outside of the Cali (hence the statement of facts).
4) I can keep my vintage yellow-on-blue personalized plate.
5) I don't have to endure a TX safety inspection
6) I don't have to plaster all those gaaawd-awful ugly Texas state stickers all over my windshield (Cali requires one tiny sticker on the rear plate).
7) This is all perfectly legal to do.
Now all you Texas boys don't get too upset... but in THIS case at least one thing is clear...

I once misplaced my new registration or forgot to renew and went for about 11 months before a cop saw I was out of date. He gave me a $50 ticket. I went to DMV and renewed and they simply started me over at that point for about $85, as I recall and I got a full year out of the new registration. The ticket was cheaper than the year I didn't have to pay for, and I don't think I got any points because it was not considered a moving violation.

Years ago when I was in the Air Force in Washington I too had maintained my Colorado residence and had my cars registered here. Colo had a longer grace period than Wash and a cop stopped me for the out of date plate. I actually had the new plates on the seat next to me in my 356C, but I didn't tell the cop. I told him that Colorado had a longer grace period and I still had a couple of weeks to put updated plates on. He was an A$$ Whole so I just told him "lets go tell it to the judge!" He backed off and let me go.

I got a ticket in Plainview, Tx which is way the heck far away from my home. I knew I wasn't going to go to court way up there so I called the Justice of the Peace in whose court it would have been. I explained the situation and asked about any recourse. Mine was a speeding ticket and well over the posted allowable limits for deferred adjudication. The longer we spoke, the nicer she got, and she let me plead nolo contendre and set me up for defer/adjud. Just saying that maybe you shouldn't wait for the last minute to find out your options. Good Luck.

For the OP, What I would suggest is that you go to court with whatever documentaion you can get about the california policy about the delay in the registration process. At the same time I would, contrary to other advise, strongly oppose the speeding ticket. Take some drawings, a witness, some kind of timing data that might make some sense and point out that the cop got the wrong car because he couldn';t even get the color of you car correct, or the make, or whatever else is not correct on the ticket (and there might be something) and some pictures of the scene where this was supposed to take place and point out that he has the wrong mile marker in the citation. In other words read some of the other reference material that others have directed you to and put up a case.
One thing that I have found over the years is that there is no benefit to giving up anything in court. My philosophy on that is that generosity is worth nothing in court. If you don't fight the speed the speed ticket is a done deal and then you have only what defense you can put up on the registration. In fact, if you oppose both of them the judge is very very likely to simply fold on the registration assuming that you can't really conjur up some defense on the speeding. On the other hand:
You have to realize that the judge in this kind of court is accustom to simply finding just about everyone guilty. However the judge is in need of some limited and occasional opportunity to find someone not guilty so that they can have some statistics that show how objective that really are. But, to be one of the not guilty people you have to show that you have really put some effort into your case, because those are the ones she or he is looking for to find not guilty.
You might win on both charges.

Then, there is always plea bargaining. If there is anyone to bargain with, try to have the speeding reduced and the registration dismissed. Might also try for a deferred judgment or prosecution and pay the same fine for the speeding, but no conviction or points on the record.
Even if the DA is not perhaps involved in the case, the court clerk may very well have some settlement guidelines for a plea of guilty. You need to call the court and ask. Or call an attorney in that jurisdiction and get some local advise. They don't bite--too hard.

In Georgia you can contact the judge that will hold the case and talk to them directly, explain the situation and in most cases ( if you are in the right ) can and will dispose of the case to keep it out of the courtroom.

For reference, the speeding was for "79" in a "70" zone.

I have beat two speeding tickets in the recent poast for the wrong color. However, they were both cases where I could put on some defensae with exhibits and witnesses that also raised reasonable doubt.
Do you have any idea how much doubt there has to be to be reasonable doubt?
Call an attorney over there and talk to him or her about the procedure and prosecutorial setting.

I'd just pay it if there are no other repercussions. Or go through the court process and get it dismissed, down-graded or "continued for dismissal pending no same or similar." That's a key phrase in my part of the country.
