Default Requesting Insurance Claim Tips

Earlier this week my '80 was hit in my company's parking lot and sustained some damage to the passenger side front quarter in front of the right wheel. This was caused by a Toyota pickup truck with an oversized bumper backing into my car. (sorry no photos). The damage broke the side marker light in half and pressed it inward with the fender being pushed inward deforming the light opening and causing a crease to form all the way to the seam where the front fascia meets the fender. The offender was insured and AAA is going to pay to have the work done. What I really want is a new fender rather than a straightening, glaze fill, and repaint. Is there some way to ensure that I get my way rather than having the insurer try to do the easy way out and repair rather than replace? The car does have previous damage to a rear quarter (about the same amount of damage was done in the past) and this was repaired with glaze etc. It is noticeable because the job wasn't perfect. I was told by the shop that the adjusters usually will look for other imperfections in the car to justify going the cheap way out. How can I ensure that any shortcomings in the car's condition aren't an influence and that I get all the money to do the job the right way? Overall the car really looks very good even though it is 25 years old. Pretty much all original except for the previous damage and the front / rear fascia being repainted (front one done poorly however and needs to be redone due to some chipping).

The damage to the rear was on a steel body part which is suitable (but not preferred) for glazing. Since the front end is aluminum, glazing IMHO should not be accepted. BTW I doubt if you can find a new body part, but I'm sure a good used one is available from one of the big three.

Yeah right, I was injured sitting in my office when I had a heart attack as the secretary came in to tell me the bad news. I may have a claim for pain and suffering!

Ever here of emotional duress, high anxeity, panic attacks, and if your female you get XXX_______ syndrome to boot. Your in CA I'm sure something can be done.

it's disgusting, but the system here is geared for it. there are accident "mills" consisting of nothing more than liars and cheats with pre-printed forms - just sign on the line & you'll get a check... insurance co's find it cheaper to just settle than pay $400/hr atty fees to fight....it's sick...

I've reported some of them, but to no avail... an insurance rep @ mecury actually had the gall to tell me the next time I'm involved in anything, claim any type of injury or I'd be screwed...I was hit by a speeding driver while he was on the WRONG side of a 4 lane divided road, clipped my rt front bumper w/his rt door - then he claimed he was injured and sued ME!! it was a non impact accident!!! it's insane!!! if you are of color, even better - nobody wants to be questioned on that one...

just threaten to sue everyone, and you'll be taken care of.... a 2nd estimate for fixing it right might be in order also...everything is negotiable, right or wrong sadly seems irrelevent...

just mention pain & suffering, duress, loss of consortium - heck - I'm sure you may have even suffered a possible career impedimant as a result - your life is ruined because of this menance to society!!! you are afraid to sue your firm for poorly designed parking facilities, because you could be fired!!! what a mess!!! you poor thing!!! sounds like a six figure settlement to me...start there and you'll get your car fixed right...
