Unhappy just got a ticket :( cheer me up

wow...what a sh!tty day today was....first i fail emissions, then I get lost and can't find the place I'm going to, then I get a ticket on the h-way. I feel like crap. What's more, i got clocked doing 79 in a 55...it's changed from 65 to 55...annnnd the guy wrote that i had no seatbelt on...."sir, i distinctly remember taking it off to get my registration".....I HAD it on. I've been reamed and it hurts. I know this has been done but any suggestions on how to present this when appealing, let me kno....oh, and my speedo's off a bit too if that helps.

Bro, my advice is to goto court. You don't need a case even though you were speeding. They really want the $$$, not to give people points. Set a court date, than goto the court 2 hrs before your trial, than talk to the prosecutor. He might as well drop the points for speeding, but you'll have to pay for the tickets.

You can take comfort in the fact that there are all those poor drivers out there that tailgate,run lights, commit unsave manouvers,talk on cell phones, put on makeup, turn left in front of oncoming cars, pull out from side streets, drive DUI or on drugs, have no insurance, no brakes, bald tires, one headlight, never use turn signals, and have never had a ticket, gets a 40% discount plus bonus points for being claim free.
But you sir violated the unrealistically low speed limit so you will pay.

Here's a little good news - I got a bogus speeding ticket awhile back and pleaded not guilty at the initial hearing. Here in GA you choose between a jury trial and letting a judge decide the case. I chose the judge and went with a list of questions and pictures of the intersection where I supposedly got clocked. Turned out that because the policeman did not show up, my case was dismissed for "lack of prosecution". I did not get the satisfaction of proving my case, but I'll take the dismissal anytime. There was at least a dozen people that also had dismissals for "failure to prosecute".

On a side note - before my case there was a lady involved in an accident who got her ticket dismissed for "failure to yield" on a left turn. It turned out that the other the other driver had already pleaded guilty to "running a red light"! The same policeman had written both tickets, even though they contradicted each other!

Go check out the <a href="http://www.mmotorists.org" target="_blank">www.mmotorists.org</a> website and look through the free stuff and "testimonials" for ideas. Of course they can sell you a kit telling you how to file a discovery motion to learn where the policeman was located, what kind of radar gun was used, calibration records, etc.

Goto court, the prosecutor will take the speeding points of your insurance, but in return you plead guilty to the charges, which is normal. You're going to end up shelling out $$ though, but having no points is 100x better. The costs usually are the cost of the ticket, and court fees. I have my court date this monday.

It doesnt work like that in Mass, look, go to court and make sure to remember what the cop looked like, because alot of the time they will have a fill in cop and wont tell you. If your cop is not there to back up his story, you win. I contest every ticket I get because 90% of the time the cop doesnt show up! I once got bagged on sturrow drive doing 90 around a corner in brighton at 3am, I swear I woke the cop up!!!! Anyway, he did not get me on radar, so when I went to court and he was not there, I said "when I came around the corner I saw the cruiser and got startled and missed a shift and the engine reved pritty high, so he must have assumed I was speeding. I do drive a Porsche." It worked!!! what town did this happen in? I live in Boston.

thnx for the advise.......this was in fall river.....the cop walked out in the highway and signaled me over...said he clocked me at 79..

If it is not him in court, say there was a honda or something next to you taunting you and he must have clocked him, and you feel you got singeled out because you drive a Porsche. half the time it is true anyway............. IF IT IS HIM, say you were speeding (he got ya anyway), but you want to contest the seatbelt thing, and explain what you did. Good luck.

also... try to delay yor court date as long as possible. Come up with a good excuse and call the county court. The longer u delay it, the better the chances that your ticketing officer wont show

They delayed my court date for 3 FREAKING MONTHS!! They just keep postponing it.

3 months ain't bad. last ticket i got was about 5 years ago. i contested it and got a date 3 months later. then called the courthouse to find out the time limit to reschedule. called 2 weeks ahead and got it changed to another 3 months later (sometimes the cops don't get the change notice). got to court and the judge went home sick. 2 months after that i got to court, no cop, no tickie...

but now in WA the cop doesn't even have to show up (unless you subpoena him). his signed, sworn statement on the ticket is the same as him being there.
