Default Remeber the accident that totalled my red car?

Well, I got charged with it, had to pay a small fine...blah blah blah. I was hit by a woman in a red Dodge Durango that was going 65. Was it my fault? Yes, in a way. I pulled out in front of her, but the sun was in my eyes, and she could have avoided teh accident. Police said that they could tell she didn't step on her brakes until about 20 foot away from me...yet she says she was laying on her horn for about half a mile...yet...no one heard it...and i thought the stopping distance of a dodge durango was much less than a half mile...

Anyway, today, I found out I may be getting some money back. See, she got in another accident, again, right in front of my house (just like mine), and it was under almost the same circumstances...guy pulls out of the road across teh street...she did the same thing...used the same excuses...except she accidently let slip that she was calling someone on her cell phone. So, the police called her house, and talked to her father, who was in the car with her at the time of my accident, and he said they had been talking right before the accident happend.

Life comes full circle...

Good I hope it comes out when the ins. companys duke it out.....cuase if it does itll help alot.

WOW< thats insane. I mean if she was a reckless driver, and thats what caused the accident, I'd say she deserves to pay. Get her off the road!!!
good luck getting some money back on this one!

It may be worth your while to get her cell phone records for the day that she hit you. If she was talking on the cell phone at the time of your accident, perhaps you could get your ticket reversed, or have a civil action to recover from her. Worth considering.

I HATE cell phone drivers- Ever friggin heard of a hands free headset? DUH!

Gawd- I see everyone too busy chatting on their phone to indicate turns, stop in time, or be a safe driver. You are driving a CAR dammit!

Glad to hear it. I also agree with Daddio, see if you can get the phone records for that day.

1) Your insurance premium will be reduced, probably dramatically, if it is decided that you are not at fault

2) Some one needs to get her off the road if this is something that happens more than once, here's your chance to help make the roads a bit safer.

And Macfreak, I wouldn't exactly call talking on the cell phone reckless. negligent maybe, but probably not reckless.

Haha, good to hear things are finally getting better for you. I can't stand people that talk on their cell phone and drive, no signal lights, never shoulder checking, really slow to react, always drifting in their lanes, etc...
At least that's how they drive around here.

I've been doing a fair amount of research on this and it turns out using a handset doesn't really improve the safety of the driver using the cellphone. Just being on the phone makes them less attentive, slower reactions, etc. There was a study released this week reporting that a 20-year-old driving while on the phone has the same, slower reactions as a driver over 60.

I have wondered whether talking to a passenger in the vehicle has the same effect, but perhaps talking a disembodied voice over the phone makes you concentrate on it more and less on the road.

The reason I've been following this, is because companies, and my boss in particular, are worried that they can be sued if their employee is talking on a company phone and causes an accident.

So find out if it's a company-owned phone she was talking on! Good luck.
