Default Totaled car...salvage? semi-OT

Don't worry it's not my 951 thats totaled. My sister just got rear ended at about 40mph in her 97 nissan pathfinder, both the insurance companies say that the car is totaled. One agent said that you can buy it back somehow but that it is illegal to part it out like a salvage yard. I'm guessing that we would have to get a salvage title for the car but we have never bought a car back after it has been totaled or gotten a salvage title. If anyone can tell me what the procedure is to get any of this done it will really help me out.

btw nobody was hurt in the wreck.

Why would it be illegal to part it out?
