Thoughts on Crash Damage Responsibility?

Holy **** he borrowed his car and consumables for FREE?!
That's the thanks he gets??!!, wow.
Yes, I broke stuff in borrowed cars and I paid for the repair. It wasn't my fault, I just happen to be in the car when it broke. Or maybe I'm a rough driver and broke it. In my world you break it you buy it.
In this case the car was pretty great (Fast, podiums) and well maintained by a prominent shop. In this case, he just wrecked hard, he should be thankful to get a free ride, not be in the hospital and thank his lucky stars that there was good insurance with a 25K deductible that he upfront agreed to pay.
Than he doesn't pay up. Sad, despicable situation.
Value was irrelevant, they agreed, its insured, I ball it up, I pay $25K.
Then doesn't.

I won't dignify the nonsense about VIR other than to say I'm happy to make the owner whole. As far as I am aware, based on the info I have received to date, the owner has made $ (better than whole) on this given the insurance payout, sale of transmission, sale of engine and my payment. With perhaps other valuable things still to sell. On top of that, he has a newer, nicer car. In hind sight, it would have been better for me to pay the deductible and take the car and sell off the parts. The owner knows how to reach me if we still need to sort any of this.
apparently he changed his mind not only about "sort[ing] any of this" but he is quitting racing after Blancpain COTA and his 991R is for sale.
glad to hear, couldn't have happened to a nicer fellow.
but sad as I was looking forward to uncomfortable moments at drivers meetings.

I think the car is the cheapest part of racing. Being non-professional racers how does one protect from this situation and an accusation of your improper car prep that you own and the other guy got hurt in? I can't even find liability insurance for myself outside the SCCA policy that lists me as an additional insured. Are people sharing cars doing enduros and such just taking on unknown financial risk?

If you let someone drive who wants to, or have a co-driver in an enduro. or whatever --- then you need an agreement ahead of time. Whether people will actually stick to it and what your remedies are when they flake...paging Luigi...call your office....
