The whole thing sucks all around.
This issue aside I do think the owner and driver should have a written agreement on value of car. If hey cant agree on a total loss value thats reason enough to not share a car.

this deal was specifically about a crash and the 25k deductible.
this was not a rental.
Joe paid zero $ to drive the car.
Joe paid zero $ for the stickers.
Joe paid zero $ for transport.
Joe paid zero $ for support.
Joe paid zero $ for prep.
Joe paid zero $ for anything.
Joe did agree to pay the $25k deductible if he wrecked the car.
Joe paid $11k.
Stu is still waiting for $14k from Joe.
Stu has sent messages to Joe requesting $14k.

So if I drive someone’s car and the motor blows up, with no fault to me, I have to pay? If the brakes fail and I hit a wall due to poor maintenance procedures I pay?
I honestly don’t have an opinion one way or another on this debate, as I don’t know if we have all the facts. As was previously stated by Texas_RS, there’s always a third perspective.
In this case the car was pretty great (Fast, podiums) and well maintained by a prominent shop. In this case, he just wrecked hard, he should be thankful to get a free ride, not be in the hospital and thank his lucky stars that there was good insurance with a 25K deductible that he upfront agreed to pay.
Than he doesn't pay up. Sad, despicable situation.

Yes, I broke stuff in borrowed cars and I paid for the repair. It wasn't my fault, I just happen to be in the car when it broke. Or maybe I'm a rough driver and broke it. In my world you break it you buy it.

Seriously however, STU is a very nice person and I can imagine how he feels seeing his car/weekend become toast and then have to be in the position to have to ask for the deductable and then get less then half of it...

I know him as a true gentleman, he wasn't happy about it at 48hrs and I probably is taking it on the chin, but this thread must be a bitter pill for him.
Maybe he lets it go, or gets in touch with OP I don't think he will post things out in the open.

This thread is Sooooo Terribly Sad.
back in the day, I rented my race car a few times.
Just a simple agreement that mechanical damage wasn't their responsibility, but any crash was, and they would have it fixed or pay for fixing it.
I been hit and done some hitting, and can't remember not talking to the other driver, and apologies given.
-Sometimes it took till the next race weekend, but a race class is too small and the prize money too little to hold grudges. at the end of the day, it's just a stupid 25 dollar trophy.
SM or 944 cup, or any single car class is going to be super competitive. What makes it affordable is all the money is in the drivetrain and suspension. if it gets destroyed, just get a new tub and move everything over.

This thread so clearly illustrates the reason why we have lawyers and the legal system we do. You start with two parties who think they are right, mix in some muddy facts, throw in some ego and money, and let marinate.
Behind every annoying lawyers is a client who "knows he is right!"

That being said, I have hundreds of lawsuits going right now. Mostly because of hard-headed and unreasonable people/positions.
