Bunganut Pig owners cited for having illegal gambling machines

http://www.msnbc.msn.com/id/44320246.../#.TlwbcTvUp_4

(The title is more entertaining than the story)

A Murfreesboro (TN) business has been busted for allegedly running an illegal gambling operation. An agent with Tennessee Alcoholic Beverage and Control (ABC) found a half dozen of the gaming machines at the Bunganut Pig where customers would get cash payouts.

At the Bunganut Pig, 1602 West Northfield Blvd. in Murfreesboro, customers come for ‘Good Food and Good Cheer.'

"We have gotten information that there were some gambling devices on the premises," ABC Chief Law Enforcement Officer Mark Hutchens said.

But Tennessee Alcoholic Beverage Commission agents say you could get illegal gambling there as well.

"Owners (often) would say they didn't know these were illegal gambling devices," Hutchens said.

Acting on an anonymous tip about winning customers receiving payoffs, agents entered the business on Aug. 16 and allegedly found six gambling devices.

Hutchens said, "We taped up the machines so nobody could enter them until we could be present when they opened the machines."

One of the owners told the agent he didn't have a key, and the machines belonged to an amusement company. The next day, the agent returned.

"He was able to get money out of three of the machines the other three machines were empty," said Hutchens.

$197 was confiscated. The owners of the business, Rudy Arn and Tony Gainous Jr., will be receiving a citation in the mail for the possession of illegal gambling devices. They also face a fine of $350 per machine, or $2,100.

ABC agents say illegal gambling machines are not as common as they were in the past since the state's attorney general handed down an opinion that they are illegal.

"These machines have knock off devices inside. They have metered counters, so if they are paying off on these machines then they know how many credits the individuals have on that," Mark Hutchens said.

ABC agents say this type of gambling won't be tolerated in the state.

"We will continue to pursue criminal and administrative violations against these individuals," Hutchens added.

ABC agents say the owners of Bunganut Pig will not face any criminal charges. In order for them to charge them criminally they would have had to witness him paying off a customer or receive a payoff themselves.

ABC ordered the owners to dispose of the illegal machines.

Channel 4 News attempted to get the owner's side of the story, but the door to the business was locked, even though it is supposed to open at 11 a.m.

Our calls to the business also were not returned.

But co-owner Tony Gainous told our news partner the Daily News Journal he was not aware his business had been inspected or fined. He referred all questions to Rudy Arn.
