Wow, I just read this entire thread! You took this thing all the way to arbitration. Let me tell you, arbitration is the biggest travesty to American jurisprudence. I’m willing to bet my left and right nut that this did not end well for the consumer and only the attorneys won! Expensive way to prove a point. In the fine fine print of these sales contacts is a clause that any disputes must be resolved in front of an arbitrator. There is a reason for that!

I signed a nondisclosure as part of the process of replacing a lemon car. Perhaps the OP has similar constraints.

I do a fair amount of litigation and frequently the contracts have arbitration provisions. Generally speaking arbitration is waivable by the parties but if the other side chooses to enforce it, off to arbitration you go. My experience is that it is nothing but more expensive than standard litigation. Arbitration is preferred as an avenue to limit liability when dealing with potential class action situations but for one-off cases, it is not the way to go. Just my $.02 and I hope the OP prevailed and is enjoying a new Porsche.
