So...... I was a bit too enthusiastic (and irresponsible) with the right pedal today and got nabbed on Route 87 doing 91 in a 65.... first speeding ticket in 9 years, and first one in the state of NY...

Would anyone be so kind as to advise on the best route to avoid points and the ticket (if possible)? I am an out of state driver (live in NJ)

Does your State offer Deferred Prosecution? Go in our your court date and ask the judge (who will ask the DA) for DP. Maybe do 26 hours of community service (1 hour for every mph over the posted), and walk. You don't need an attorney. Good luck.

I am out of state, live in NJ... did a quick google search and it says NY state doesn't offer such amenities

Plead not guilty. Postpone the court date as often and as long as possible, and hope that when you finally do go to court, that the cop does not show up. No cop equals immediate dismissal.

Or, hire a traffic lawyer. He/she will get points reduced and may even get the speeding ticket changed to something like following too close.

If this is your first speeding ticket in 9 years, you may not really have to worry too much. My wife got a speeding ticket a few years ago, first in many years, and insurance did not go up. Then I got one and insurance did not go up. Then I got another one a few years later, and insurance did not go up. It depends on how long you have stayed with insurance company and of course the insurance company itself.

Give it a few days. Your mailbox will be inundated with fix-it-ticket lawyers. Hire one. They'll get it reduced to a lesser charge, but you'll pay, and won't need to appear. Keeps from getting your insurance dinged.

Same thing happened me two years ago in upstate NY at pretty much the same speed. I paid the fine immediately and because the ticket was from out of state NJ only applied two points to my license. Drove clean for one year from the date of the ticket and the points dropped off my license. Because it was only two points insurance was never notified, no surcharges, no nothing.

If it's Westchester I would hire Harold Dee. I was given a ticket that made no sense in Westchester for 12 points. As a CT licensed driver, which would have amounted to revoked driving in NY. My first ticket in over 10 years. Harold got it thrown out. Worth the cost.

The speeding fine is not much, a few hundred but they are also going to nail you with a civil action and make you pay an additional $600. I do believe that the SCOTUS just made this unconstitutional but they will probably try it anyway since you are out of state. Happened to my wife. Same speed.

Then when you don’t respond they’ll automatically revoke your ‘NY state driving privileges’ and lie in wait. Then, next time, you’ll have the opportunity to pay the additional fine by web on the side of the road assuming there’s data coverage.

In bygone days this would be considered highway robbery. Literally. Not today though.

Years ago, I had an in state (NJ) on Palisades Pkwy incident where it was like 21 over (if I recall correctly). I pleaded not guilty and went to court. I also had a clean record for the longest time. I waited to speak to the prosecutor and found he just wanted to tack on the fines to lower the penalties (eg. pay an extra $150 over the normal fine and get only 2 points, but he said if I pay another $200 on top of that, no points and wreckless driving charge that carried no points). I opted to pay the most and get least penalties. They just want money.

You can most likely negotiate this without a lawyer. Just make sure you plead not guilty and then show up at the court date. Good luck!

How did they get you with laser or with a regular radar gun?

Best thing to do is get a local lawyer involved and they will make the points given be significantly lower.
