Well it appears LUXSPORT is really digging in with their lawsuit threats. The vehicle owner is worried about his business relationship suffering with the eBay lister if he doesn't sell the car to LUXSPORT.

The ebay lister thinks the dealership has a legit case because he signed a Bill of Sale. My thoughts are that the bill of sale is worthless since he isn't the actual owner and since the dealer should have known he isn't the owner based on the copy of the title listing someone else as owner and the actual wording of the ebay auction. Thoughts?

If the owner had a verbal contract with the eBay'er to sell the car, then perhaps the agreement between Lux and the eBay'er would be deemed valid. Sad situation as that very car will be for sale for at least $10k more in less than a week. Keep fighting, may work out in your favor as you did win the eBay auction.

If you really want the car that bad, I would spend a few hundred $$$ and consult with a good attorney and see where you stand. Maybe rennlister Rinty can offer some legal opinions. Just my thoughts. Good luck. Mike

They are only threats and will never progress more than that for the reason listed above. I would have an attorney review the bill of sale and see how it is written. Does it list both the owner and the agent; have all parties signed off? If the owner is really concerned about his reputation, he might suggest the attorney act as an intermediary and propose that the car be sold to the OP for $69,000 (agreed to price), with $4,000 of those proceeds going to Luxsport in consideration for the canceled deal. The seller still nets $65,000 (same price as if he sold it directly to Luxsport) and everyone gets something. If Luxsport balks at the offer, then I would take my chances and cut them out of the deal completely. They would have to retain counsel in a different state; simply not going to happen.

On the surface that seems like a great idea but I'm not sure I want a single dollar of my money going to a lawyer-pushing flipper simply out of principle. I think anyone with two brain cells can put together that the chances of the dealer successfully winning a lawsuit on an individual who never owned the car (as was obvious to anyone) are slim to none. Unfortunately, the owner is now getting the full $65,000 and it seems the extra money he'd get from me isn't worth the hassle to him.

Dealer probably said $65k in bank tomorrow via wire, no PPI, truck to pick car up in 3 days. For some people, that's worth the $4k. Sorry to hear, but not any fault of yours. The hunt goes on.

If your agent has color of authority to sign the contract, then it may well be binding

Do a deal with the owner....he controls the car...no one else!

I still feel that a Nigerian price will appear in all of this sooner or later. I'd run away from any of this screaming. Just my $0.02

Na. This is a case of one guy trying to take advantage of his friend and flip a 993 with no skin in the game himself. I've hashed it out with both of them. The car owner is a good guy who doesn't want to mess up his ongoing business relationship in a small town with a bunch of mutual friends who would have to choose sides. The ebay lister is one of the biggest pansies I've ever spoken to - I wish I was exaggerating. In fact, if the ebay lister actually owned the 993 and was representative of the typical 993 owner I'd probably grow a mullet and start driving 80's Corvettes.
