CP. So very sorry. Happier to know you and hopefully the lady were not hurt badly. Looks like your M5 faired much better than the big chevy.
Insurance: You might be surprised. I had a Maxima that was totaled, other drivers fault. His Ins co. contacted me, made me an offer for more than I paid for the car. I agreed. Got check in a couple of weeks. Bought another vehicle.
Everything may go very smooth. Have a $ in mind. Tell them what you will take - start a little high - they want to settle as quickly as possible.
Good luck. Glad you were not seriously hurt.

Wow! Glad you're OK and she is apparently not terribly hurt. Auto safety has come a long way.....
I've had experience with insurance companies in multiple auto and real estate claims, and I think you've heard lots of good advise already. But please let me offer this: Your insurance company will not be looking out for your best interests. Don't forget that. They just want to settle the claim and collect from hers as quickly as possible. They don't care about your mods.
Someone earlier referenced an attorney familier with auto insurance and their quirks. Please call him tomorrow or another attorney for counsel. The insurance companies will treat your case completely different with counsel representing you. If you go it alone, be prepared for delays, more BS than Barbra Boxer can muster, and outright lies. You need representation, it will pay for itself. You also need witnesses if she doesn't admit guilt to the offcers. Do you have any?
Good luck, see your Doctor tomorrow (hell tonight) if necessary, and I'm glad you weren't in the RUF for multiple reasons.....

Pong, WOW! Really sorry to hear this! Like said above, glad to hear you (and the lady) are ok. Lots of great advice mentioned already, so I wont repeat. Be sure to take anti-inflamatories starting right now as this may help your future stiffness.
Sorry to hear this!

Wow at least you're okay! I'm hurting for the M5 though...poor car.
Regarding the insurance, if it is 100% her fault (which it should be) then her insurance should be covering you not your own i believe.

I'm relieved you're okay, CP. I play a lawyer in real life, but don't have much to add to the sound advice you've received so far. Arm yourself with as much information, evidence, and professional assistance as possible; expect the worst from the process and if it goes smoothly you'll be pleasantly surprised. Finally, not all injuries manifest themselves in the first 24-48 hours after an accident, so pay close attention to how you feel and how your major systems work over the coming days and weeks.
All the best to you, and keep us posted.

CP,
Sorry to hear about your accident; glad to hear you are okay.
Your BEST leverage, especially if it can be documented via witnesses/police report/other party being ticketed for running red light/etc. is personal injury - PERIOD.
It is exceedingly common for soft tissue injuries to show up later after the accident...wink wink. I hope none of these actually show up in you and so does her insurance company. I am not advocating extortion of her insurance, just recovering appropriate capital to compensate you for your loss (car repalcement, medical costs, modification cost, warrenty cost, etc).
Forget ethics, insurance companies forgot about them a long time ago. They WILL make offers to settle and hope you bite. Do not settle for less than your losses. Let an attorney represent you so they know you are serious. It would NEVER get into court.
Just my cynical opinion.

Pong,
Wow, I so glad to hear that you're okay. Just be very caucious .... some internal injuries do not show up immediately, somtimes not for months. Settling for the replacement of the M5 is one issue but making sure that you're okay and from internal injuries is another issure.
Just make sure you take it easy for a few days.
