It looks like OP is in CA.
As others have said all deposits in CA are refundable.
Non-refundable deposits are like unicorn tears - a figment of dealer gobblyspeak.
If 10% is too much or you’re uncomfortable with that amount - even one that’s refundable - maybe simply ask the dealer to hold your credit card info on file, as a sort of unicorn collateral for your, ahem, “non refundable deposit”.

You guys have it so easy in USA. I had to put down 55k on an S that came 350k (almost 120pc tax). Crazy taxes on cars here in Asia. On the other hand my income/profits tax is 17pc so can’t complain...

I am working my way to purchasing a 2021 992 C4S Coupe that with options on the configurator is coming out at around $157,000. After chatting with my nearest dealer I understand I likely won't see it turn up until spring 2021 earliest if I order in the next week or two.
This will be my first 911. When I raised the question of what size deposit would secure the order 10% was mentioned which is c. $15,000. Thats quite a lot for a dealer to be sitting on for 6-8 months.
Dealer commented that there is some protection here for them against orders with weird color schemes and option configurations that are hard to sell if the order is cancelled. In my case I am contemplating night blue metallic exterior with the (two-tone) slate gray and chalk interior loaded with options which would not seem hard to resell..

$10k down on a Spyder allocations. Hadn’t ordered in over 10 yrs.

I think it actually may be possible (not certain) to get your deposit back in every state; it would just not be worth it in some as you may need to take them to court. My contract didn’t have any liquidated damages clause or something similar and I think in most states the dealer loses under loss volume measure (there is none)

$5k deposit on ordered Carrera and $2500 on a Cayman/Boxster or Cayenne from my dealer. Also traded my car and had quite a bit of equity....they cut me a check minus $5k also but just had them hold it for me and apply it towards the difference due on my car when it gets in. That way I don't get tempted to use it for something else in the interim. LOL

Just a point of interest, I had to put down £5k in the UK for a specific allocation. I was working on the assumption this wasn't refundable.
First time buying a car from that dealer, but I had been taking my Panamera there for fixing/servicing for a few years so I wasnt totally unknown.
