Vibration is on all gears. always from 3000 rpm.
What ever the case is, it's not the engine/front of car. you can replicate it neutral. but for some reason after i put it on the hoist and tried to replicate it, it decided it wont do it in neutral any more

I have had motor mounts fail at the weirdest time leading me to think it was something else (like in your case, thinking its exhaust related) but was the mm simply failing at a weird time. I would at least check them.

It's not the balance shafts. - just checked
It seems "harmonic" that the fact it's from 3k upwards. anything under is fine. when is say fine. you wouldn't think there's a problem.

If it's only under load, make sure that none of the cv bolts are backing out. This vibration could be coming from one of the cages that is able to move away from either the trans or the hub (most likely the trans), and could even be independent of speed because it might need the combination of RPM's and the force of the load against it that is only generated above 3k RPM's.
My second suspicion would be something with the clutch.

It's RPM dependant. not speed. 5th gear 2800rpm no vibration. 1st gear 2800 no vibrations. if its over 3000 there's vibration.
So it's not the CV's. they're new and i've got the car on the hoist and have already checked them.

That was 1 plan. but after putting it on the hoist it was difficult to replicate it while in neutral. I have the TT disconnected from the box. so i'll turn it on and see if i can hear anything unusual.

You want to push in the clutch and have the trans in gear and connected to the TT. Lock one wheel if it's an open diff and spin the other wheel. Then listen for grinding in the TT. It's sounds like a clutch issue to me thou. Maybe you lost a spring in the disc? Or a clamping spring is broken on the pressure plate? Maybe the throw out bearing is done for. Or the pilot bearing has deteriorated and destroyed the driveshaft tip and is destroying the TT bearings with its harmonics? And remember just because something is new doesn't mean it's not bad.
