In the U.S. patents are all about what is new, or unique, that has not already been patented.

This is the same as everywhere else... if someone has a unique idea, that has that idea out in the public domain, and someone else patents it, it comes down to a judge making a ruling, this rulling will only come if the patent holder crys infringement, or another party challenges the patent.

This is how patent law works.

I honestly went looking for the patent because I wanted to see WHAT was patented, and while it is nothing new in this realm, there was also no patent on it previously.

From what I can gather, their patent is building on a Japanese patent awarded in 1981, by Kubota for dual exhaust driven superchargers mounted directly above the cylinder heads to shorten the pressurized air path (connecting the turbo outlet directly to the intake)..

Abstract is available here http://www19.ipdl.inpit.go.jp/PA1/cgi-bin/PA1INIT? by searching for words "engine", "exhaust" , "injection" with a date range of 19810901 to 19810930.. it should be result number 10, which can be viewed by clicking on the "index indication" button... index number 56-115820(1981) but will not come back using that as a search string...

In all honesty, what struck me as odd was the plastering of "patented" all over the web tied to Nelson racing engines, but I had to TRY to actually find the patent (mentioned all over their site, but no mention of the actuall patent number)... most patent holders are more than happy to publish their patent number whenever they cite it!

Struck me as odd, which is why I started looking for it...

Probably should say patent pending. They may not have received a ruling yet but want everyone to know they have submitted.

Patent law in the US is more about deeper pockets than it is about ideas anymore. Very costly if any large company is interested.
